ORDINANCE N0. 88l~3 i An ordinaee to vacate certain street and alleys in the City of Eugene I~VHEREAS, heretofore the Common Council and the Board of directors of School District have negotiated for the vacation of certain streets and alleys running through property which has been acquired by the School Board for the purpose of estab° lishing a school property which Rill not oe traversed by traffic, thus endangering the students. and Whereas, the Common Council has caused the City Recorder to file in his office a certificate shoti~i.ng that all city liens and all taxes have been paid on the lands covering by the plat or portions thereof to be vacated, and Whereas, the said proposed vacation has been submitted and approved by the Planning Commission of the City of Eugene, Therefore, THE CITY OF EUGENE DOES ORDAIN hS FOLT,OVd'S: Section 1. The Common Council of the City of Eugene hereby initiates vacation pr oceedings on its own authority, without petition or consent of the property oavners, excepting as provided by statute, of the follovring described property inrthe City of Eugene . to-wit High street from 19th to 20th avenue; Mill street from 15th to 21~th avenue Ferry street from 19th to 2l~th avenue; 20th avenue from Pearl to High street. The folla~ring streets to be vacated from the West line of Driverton Addition to Patterson street. Twentieth avenue, twentyfirst avenue, twenty second avenue, twenty third avenue alleys to be vacated; Blocks 7 and 8, Teshners Addition Blocks ~,~ 1L~, 17, 18, 23, 2~, 27, 2S, 33, 3~+. Driverton Addition reserving to the City the right to enter, construct and maintain all sewers, water pipes and public utilities. Section 2. A hearing shall be held upon the proposal to vacate the streets and alleys, as herein provided, and said hearin g shall be held on the 8th day of October, 191.i.5 at the council chambers of the City Hall in Eugene, Lane County, Oregon, at 7:30 ofclock P.M. of said day, at irhich time all persons will be heard upon objections or suggesti ens with reference to the vacation of said streets and alleys, and at said time the Council will provide far the vacation of said premises or deny such vacation, and in case the vacation is made will make provisions for any damages sustained. Section 3. Such notice shall give the description of the streets and alleys to be vacated as herein set out, and state the date when this ordinance was passed; the name of any petitioners petitioninp~ for said vacation; the date when the 3~9
