<br />3s9 <br />-- <br />- =- <br />ORDINANCE PTO 8860 <br />f <br />An Ordinance to regulate the keepir>g and maintenance of animals, fowls <br />and insects in the Gity of Eugene; providing for a license, and repealing all <br />Ordinances in conflict herewith. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLuwVS: <br />Section 1. It shall be unlawful for any person, firm, company, assoc- <br />cation or corporation to keep or maintain any horse, cow, sheep, goat, livestock <br />or any other like domestic animal; any fowls or birds, including doves; any bees <br />or other insects, without having obtained a license as herein provided. <br />Section 2. Any person desiring to keep any animal, fowl, bird or insect <br />hereinbefore mentioned, within the City, shall make a written application to the <br />City Health Department of the city for a license therefor, showing the number and <br />kind of animals, fowls, bird or insects to be kept or maintained, and such a des' <br />cription or address as shall identify the place where such animal, fowl, bird or <br />insect is to be kept, and any other information required by the City Health Depart- <br />ment or necessary to enable him to determine the place and manner in which such <br />creatures are kept, with respect to the comfort and convenience of others. <br />Section 3. 3efore acting on any such license, the City fiealth Officer <br />shall investigate the character of the applicant and all of the facts surrounding <br />the maintenance of such creature a~~ such place, with a view to its being kept in <br />such a manner as riot to endan ger or affect the health, comfort and convenience of <br />other citizens of the city, and after a full consideration of all the facts and <br />circumstances, if it shall appear that the manner of keeping and maintaining such <br />creature shall not be detrimental to the welfare of the city or its citizens, the <br />City Health Officer shall endorse upon such application his approval thereof; but <br />if it shall appear from his inspection that a license should not be granted, he shall <br />endorse upon the application his rejection thereof. <br />Section 1.~. In case any application for liconse shall be rejected by <br />the City Health Lepartment, the applicant may appeal to the `Common Council by <br />appearing before them at their next regular meeting and presenting his rejected <br />application fur review and the Council shall thereupon hear the applicant and <br />either grant the license or adopt the recommendation of the City Health Department, <br />and the action of the Council upon such application shall be final. <br />Section 5. Upon receipt by the City Recorder of any application as here- <br />inbefore provided, with the approval of the City Health Officer endorsed theron, <br />or with the endorsement of the Common Council, the Recorder shall immediately issue <br />a license in accordance therewith and shall make a record of such license. Such <br />license shall terminate on the first of January following its issuance; shall <br />name the person to whom it is granted; the date of its expiration; the number and <br />kind of animals, fowls, birds or insects to be kept, and the place where they are <br />
