Asaddressedbelowundersubsection(3),andconsistentwiththesepolicies,aminimumlevelof <br />keyurbanfacilitiesandservicescanbeprovidedtotheareainanorderlyandefficientmanner. <br />TheMetroPlandesignatestheannexationareaasappropriateforLowDensityResidentialuse. <br />ThecurrentzoningofAGisintendedtoallowagriculturaluseswithintheUGBuntillandis <br />convertedtourbanuse.Agriculturalusesareconsideredinterimusesuntilpublicfacilitiesand <br />servicescanbeprovided.Inorderforthispropertytofurtherdevelopasresidentialpropertyin <br />thefuture,azonechangetoR1LowDensityResidentialwillbenecessary. <br />TheWillakenzieAreaPlan(WAP)istheadoptedrefinementplanforthesubjectproperty.The <br />subjectpropertyislocatedwithintheUnincorporatedSubareaoftheWAP.Noneofthegeneral <br />"ResidentialLandUsePolicies"appeartobedirectlyapplicabletothesubjectrequest.The <br />"PublicFacilitiesandServicesElement"policiesoftheWAParedirectedatlocalgovernment; <br />however,thepremiseofthesepolicies(regardingtheprovisionofurbanservices)isthe <br />assumptionthatthepropertieswithintheUGBwillbeannexed. <br />Asdiscussedinthissubsection,andfurtherdetailedundersubsection(3)below,theproposed <br />annexationisconsistentwiththeMetroPlangrowthmanagementpoliciesandcanbeservedby <br />theminimumlevelofkeyurbanservices.TheannexationproceduresbeginningatEC9.7800are <br />consistentwithStatelawandtherefore,asfoundthroughoutthisreport,theannexationis <br />consistentwithStatelaw. <br />Therefore,basedonthefindingsabove,theproposalisconsistentwiththeapplicablepoliciesof <br />theMetroPlan. <br />EC9.7825(3)Theproposedannexationwillresultinaboundaryinwhichtheminimumlevelofkeyurbanfacilities <br />andservices,asdefinedintheMetroPlan,canbeprovidedinanorderly,efficient,andtimely <br />manner. <br />CompliesFindings:Consistentwiththiscriterion,theproposedannexationwillresultinaboundaryin <br />whichtheminimumlevelofkeyurbanfacilitiesandservicescanbeprovidedinanorderly, <br />YESNO <br />efficient,andtimelymannerasdetailedbelow: <br />Wastewater <br />ThenearestpublicwastewatersystemiswithinMirrorPondWay,approximately200feetwest <br />ofthesubjectproperty.Thereisanexisting8inchlinethatcouldbefeasiblyextendedeastto <br />servethesubjectproperty.Asaninformationalitem,thedepthoftheexistingline(inMirror <br />Pond)isonlyabout5feetbelowsurface,andbecausegravityfallisrequiredwithinthepublic <br />wastewatersystem,thereisastandardminimumslopetoconsiderwiththedesign;therefore, <br />extensionofthissegmentofthepublicsystemendsupbeingrelativelyshallowattheconnection <br />pointforthesubjectproperty,whichmayresultinaneedforprivatepumps,oranalternative <br />solutiontomeetadequateslopeminimums. <br />Additionally,therearenocapitalimprovementsplannedtoinstallpublicwastewaterinthisarea <br />atthistime,andtherefore,theproposedextensionofpublicwastewatertoservethesubject <br />propertywouldbereviewedthroughtheprivatelyengineeredpublicimprovement(PEPI) <br />process,andfinancialsuretywouldbetheresponsibilityoftheprivatedeveloper. <br />Stormwater <br />Publicstormwatersystemsarenotavailabletoservethisproperty.ThesoilclassificationisType <br />B,whichtypicallyindicatesthatgoodinfiltrationratescanbeexpected.Developmentproposals <br />mustdemonstrateconsistencywithfloodcontrolstandards;onsiteretentionisafeasibleoption <br />forthissite.Compliancewithapplicablestormwaterdevelopmentstandardswillbeensuredat <br />thetimeofdevelopment.AportionofthepropertymaybewithinSpecialFloodHazardArea <br />Stadter,JohnandMaureen(A167)October2016Page2 <br /> <br />
