•..,. <br />22 <br />oRDarA~~'cE r~ro . 9309 <br />An Ordinance adopting the plans and specifications of the City Engineer for tkie oonstruc-` <br />tion of a sanitary sewer on Emerald Street from Tvrentysixth Avenue to Tvrentyeighth Avenue in <br />the City of El.~.gene; Oregon, directing the City Recorder to advertise for bids for the construc- <br />tion of said sevrer in accordance T~rith such plans and specifications, acid notifying property <br />owners when and where the bids therefor will b e opened and cons idered .. <br />WHEREAS, the Common Council of the said City of Eugene, on the 18th day of April, 199, <br />passed Ordinance No . 9308 for the cons traction of said sewer in'the street described and set <br />forth in the title of this Ordinance, and said Ordinance eras approved by the Ddayor of the City <br />of Eugene on the 19th day of April, 19I~9; and <br />WHEREAS, Section 3 of said Ordinance directed the City Engineer to make p]_ans and speci.- <br />fications for the construction of said sewer as specified in s aid Ordinance, and to file the <br />same with the City Recorder, and <br />WHEREAS, in accordance with such instructions the Cit~T Engineer has prepardd said plans <br />and specifications and file the same with the City Recorder of said City of. Eugene on the <br />day of April, 1Q49, and the Common Council of the City of Eugene having examined and <br />approved the same; <br />THE CITY ~OF EUGEr1E DOES ORDAIN AS FOLLOt~tS: <br />Section 1. That the plans and specifications of the City Engineer for the construction <br />of a s anitary s ewer on Emerald Street frg~m Tvrentysixth to Twentyeighth Avenue in the City of <br />Eugene, and doing such work as may be necessary to completely construct the sane, are in all <br />thi~igs approved and adopted and the said -.sewer shall be constructed in accordance therewith. <br />Section 2; That the City Recorder be , and 'pis is hereby, instructed to g ive notice to <br />contractors and property owners as provided in Sections 52, 53, ~~t, 55, 56, ~6B and 57 of the <br />Charter of the City of Eugene, inviting bids f or t he, .constructiol of said s evrers as prescribed <br />in and in conformity to said plans and specifications . <br />Section 3. That the Common Council declared that the said c onstruction and the whole there- <br />of shall be let as one contract and the City Recorder is directed to state in the notice to <br />contractors and property. owrners that said crntract will be let in one contract, and to also <br />state therein the tir:e and place when and wherebids for the construction of said sevrerw ill <br />be opened and considered by the Cor~mon Council, and that at such time and place property <br />owners may f~1e remonstrances against letting said contract. <br />Section 1G. That the party whose bid is accepted for said construction sign a contract <br />for said work within ten days from the time of the receipt by him of the notification of the <br />acceptance of his bid, and the vrork thereon shall be commenced within ten days after the <br />letting of said contract, and s hall b e completed within s ixth da.gs:= thereaf~t~r, un~.ess an <br />extension of the time therefor be granted b y the Common Council.
