<br />of such facilities is sustained over time through proper operation and maintenance. A concern was <br />expressed that a development may qualify for an SDC credit for a constructed facility which fails to <br />perform as intended in the future due to a lack of maintenance, negating the original basis of the <br />credit. While the primary intent of the enforcement program is to ensure stormwater quality <br />improvements are sustained, a result of the program will also be to ensure that the basis of past SDC <br />credits continues. There will be no effect on the cost to the private facility monitoring and <br />enforcement program due to adoption of the proposed SDC credits. <br />Adequacy to the SDC administrative fee to cover increased costs of determination of credit <br />eligibility <br />The administrative fee component of the SDC covers various costs of ensuring that SDCs are <br />administered in a manner which complies with statutory requirements. The administrative fee is <br />currently five percent of the total SDC and has been adequate to cover all activity costs associated <br />with SDC administration, including SDC credit determination associated with development permits. <br />It is not anticipated that review of proposed stormwater SDC credits will add substantially to existing <br />review costs; however, the adequacy of the SDC administrative rate is reviewed periodically and will <br />be monitored for adequacy given incremental changes in SDC methodologies and related SDC <br />credits. <br />I hope this additional information and clarification is responsive to Councilor’s questions and <br />concerns.
