AssumptionsandLimitations <br />1..Thefinancialandtaximplicationsofurbanizationandannexation <br />FiscalandLegalImplications <br />totheCityofEugeneisnotdirectlyaddressedbythisWhitePaper.EcoNorthwestInc.previously <br />conductedsuchananalysis,anditisassumedthatsuchimplicationsofurbanizationand <br />annexationhavebeenorwillbeassessedelsewhere.Similarly,ananalysisofthelegaland <br />statutoryoptionsavailabletomunicipalitiesintheStateofOregonwithrespecttourbanization <br />andannexationwasnotconducted,exceptinsofarascommunitytransitionandheritage <br />initiativesandoptionsidentifiedinthisWhitePapertakeintoconsiderationthegenerallimitations <br />ofsuchlegalissues.Infact,statuteswithrespecttoannexationweresignificantlyamendedby <br />theStateofOregonLegislaturewhilethisWhitePaperwasbeingdrafted. <br />2..ThegoalofthisWhitePaperistoidentify <br />TheÒInevitabilityÓofUrbanizationandAnnexation <br />strategiesandactionsthatcouldfosterandsupportarealsensethaturbanizationandeventual <br />futureannexationdoesnotnecessarilymeananabsolutelossofheritage,controland <br />community.Thisbeingsaid,practicallyallthepotentialactionsoutlinedintheWhitePaperare <br />annexationÒneutralÓÐmanyoptionscouldbepartofstrategiesandactionsthatthetwothe <br />communities(orlocalgovernments)maywanttopursueunderANYcircumstances,andsuch <br />optionsmaybeusefulregardlessofthecurrentorfuturecircumstancesinfluencingthepaceof <br />annexation.Thecommunitiesinquestionwill,nonetheless,eventuallybecomepartoftheCity <br />anditsgovernance,basedonthesimplefactsthatRiverRoadandSantaClaraarewithinthe <br />UGB,andthatconsiderablepartsofbothneighborhoodsarealreadyannexed. <br />3.ResearchfocusedonOregonexamples,andthe <br />ApplicabilitywithinStateLandUseLaw. <br />recommendedstrategiesandactionsdescribedinthisWhitePaperaregenerallyfeasibleunder <br />OregonlanduselawandthestipulationsofORS199and222,whichgovernannexationoptions <br />inOregon,andOAR191,whichisspecifictotheLaneCountyBoundaryCommission,andother <br />applicableStateregulationsandpolicies.Acomprehensivelegalandstatutorycompliance <br />analysisofeachoptionwas,however,welloutsidethescopeofthisWhitePaper,andany <br />selectedoptionsshouldbeexaminedwiththecaveatthatadditionalresearchandpolicyanalysis <br />mayberequired. <br />4..Possiblestrategiesandactionsidentifiedin <br />ApplicabilitywithinLocalandRegionalPolicy <br />thisWhitePaperconsideredthepoliciesandauthoritiesoftheCity,andotherimpactedservice <br />providers,andtakeintoaccountapplicableregionalpoliciesandadoptedplansaccordingly.This <br />doesnotmean,however,thatpotentiallyusefulandeffectiveoptionswereomittedsimply <br />becausetheywerecontrarytoanadoptedlocalorregionalpolicy.Differingfromtheabovestated <br />generalstandardforcompliancewithStatestatutes,non-compliancewithadoptedlocalor <br />regionalpolicywasnotaÒdefaultÓcriteriafordroppingapossibletransitionorheritageoption.All <br />thingsbeingotherwiseequal,ifthepolicyorordinancechangesnecessarytomakeanotherwise <br />effectiveactionfeasiblewerewithintheauthorityoflocalorregionalgovernment,suchactions <br />havebeenincluded. <br />5.ThisWhitePaperdoesnotpurporttoexplaineach <br />ComprehensiveNatureoftheAnalysis. <br />possiblestrategyoractioninitsentirety,ortobeacompleteandauthoritativefeasibilityanalysis <br />foreach.Therearecertainlyotherideasouttherethatmaybejustasusefultothetwo <br />communities.Theoptionsdescribedhereinappeartoholdpromiseforthecommunities,butonly <br />thetestofthepublicprocesswilldecidewhatworksandwhatdoesnÕt.Thatwillbethe <br />responsibilityoftheresidentsofRiverRoadandSantaClara,theCity,County,otherlocalservice <br />providers,andotherimpactedcitizensandstakeholders.TheWhitePaperisanoutlineofideas <br />thatthetwocommunitiescouldpromoteÐorlocalgovernmentsoffer.TheWhitePaperisa <br />startingplaceÐnotafinalÒplanÓoraÒstrategyÓ. <br />RiverRoad/SantaClaraCommunityTransitionProject3 <br />TransitionandHeritageWhitePaperMay2006 <br /> <br />
