NOW, THEREFORE, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. <br />The findings set forth above are adoptedin support of this Ordinance. <br />Section 2. <br />A physical or geographic barrier capable of preventing childrenfrom <br />traversing directly between Terpene Station and Looking Glass existsas described in the above <br />findings. <br />Section 3 <br />. Upon OLCC’s issuance of a license to Terpene Station as a recreational <br />marijuana retail facility, Terpene Station may continue to operate as a recreational marijuana <br />645 River Road,Unit 3, Eugene, Oregon <br />retail facility at . <br />Section 4. <br />Due tothe January 1, 2017 deadline for Council adoption of an Ordinance <br />allowing Terpene Station to continue operating as a marijuana retail store, an emergency is <br />declared to exist that cannot be addressed by the ordinanceadoption procedures of Section <br />28(1)of the Eugene Charter of 2002. Immediately prior to adoption of this Ordinance, the City <br />Council unanimously agreed to proceed with consideration of this Ordinance with an <br />abbreviated notice of the public hearing datepursuant to Section 28(4) of the Charter. <br />Section 5. <br />As this matter has been declared an emergency, pursuant to the <br />provisions of Section 32(2) of the Eugene Charter of 2002, with the affirmative vote of two-thirds <br />of the members of the City Council, upon adoption by the Council and approval by the Mayor, or <br />passage over the Mayor’s veto, this Ordinance shall become effective immediately. <br />Passed by the City Council this Approved by the Mayor this <br />_____day ofDecember, 2016. _____ day ofDecember, 2016. <br />_______________________________ _______________________________ <br />City Recorder Mayor <br />Ordinance - Page 2 of 2 <br /> <br />
