direct the three local governments to comply with the Goal 5 Rule (OAR 660-023- <br /> 000). <br /> <br /> The Purposes and Intent section of the Goal 5 Rule (OAR 660-023-000) states: <br /> "This division establishes procedures and criteria for inventorying and evaluating <br /> Goal 5 resources and for developing land use programs to conserve and protect <br /> significant Goal 5 resources. This division explains how local governments apply <br /> Goal 5 when conducting periodic review and when amending acknowledged <br /> comprehensive plans and land use regulations." <br /> <br /> Recommendation: No change. <br /> <br /> b. Use of Both Standard Process and Safe Harbor Process within One Resource <br /> Category <br /> Issue: Can a local government use both the standard process and the safe harbor <br /> process for one resource category? <br /> <br /> Staff Analysis: In July 2003, Eugene staff asked DLCD whether or not a <br /> jurisdiction could apply the standard inventory process and the safe harbor <br /> inventory process to different sites of the same resource type, or to different <br /> portions of the same site. In a July 3, 2003 email response, DLCD staff said that a <br /> local jurisdiction can not only apply both standard and Safe Harbor processes to a <br /> single resource category, it can also split a single site between the two processes. <br /> The DLCD response states, in part, "A city may divide use of the standard and <br /> safe harbor approach for a single resource site when it is determ/ned through the <br /> standard process that there are significantly different on-site characteristics that <br /> would allow a clear distinction among various portions of the site." This question <br /> of whether the Goal 5 rule allows a split approach on methodology within a <br /> resource type may be confused with the applicability requirements of the new <br /> Goal 5 Rule, which require a jurisdiction to use only the old Goal 5 rule or only <br /> the new Goal 5 rule within all sites of a given resource type. <br /> <br /> Recommendation: No Change. <br /> <br /> c. Use of the Safe Harbor Approach Outside the UGB <br /> Issue: Do not adopt the safe harbor approach proposed for the area outside the <br /> Urban Growth Boundary (UGB). <br /> <br /> Staff Analysis: The elected officials directed staff in the spring of 1997 to <br /> proceed with the Natural Resources Study, with specific direction to apply the <br /> "safe harbor" approach on lands outside the UGB but inside the Metro Plan <br /> boundary.
