<br />III. Supplemental Findings on Utilities within Protected Wetlands <br /> <br />A. Background on Utilities within Protected Wetlands <br /> <br />In June 1996, EWEB contacted city planning staff regarding potential work on an existing <br />water line at the edge of a wetland protected by the West Eugene Wetlands Plan <br />(WEWP). This contact led to discussions with Oregon Division of State Lands staff. <br />These discussions revealed that the state's recently adopted administrative rules included <br />restrictions on uses that can be allowed within a wetland designated for Protection in a <br />wetland conservation plan (OAR 141-120-030(2) and 141-120-130(2)(a)). Excavation <br />for construction of or connection to utilities is not allowed within the Protection <br />designation. Maintenance work or repairs on a water or sewer line that passes through a <br />protected wetland site may also be prohibited in some cases. Many utility lines predate <br />the plan, and the locations of most were unknown to wetland planning staff until 1996. <br />The state rules which restrict such activities within protected wetlands were adopted <br />following local adoption of the plan in 1992. <br /> <br />Over a period of two years, staff attempted to gather all available information on the <br />location of both underground and above-ground utilities within wetlands designated or <br />proposed for Protection. Staff sent several letters and made several phone calls to each <br />utility that owns facilities in west Eugene. The information showed that several sites <br />contain existing utilities within protected wetlands. No information was received from <br />US West or AT&T Cable services about their facilities in the area.
