Consistent with its <br />obligations under the ApR.,\'" 25" , 1991 Annexation and Urban <br />Services Policy Agreement, the City agrees: <br /> <br />6.1 To seek and obtain ordinance changes from Lane County on <br />mandated parking lot and sidewalk improvements for property in the <br />Industrial Corridor area that may be required as a condition of <br />development. Such changes shall allow delay of these improvements <br />at least until the effective date of the property's annexation. <br /> <br />6. 2 To seek and obtain all necessary policy and rule changes, <br />if any, from Lane County and the Oregon Environmental Quality <br />Commission or Department of Environmental Quality to al~ow minor <br />repairs to existing septic disposal systems without mandatory <br />connection to a sanitary sewer when the sanitary sewer is <br />physically and legally available. <br /> <br />7. Waiver and Release. Property Owner holds the City, including <br />its officers, agents, and employees, harmless from any dftmages or <br />liabilities arising from the City's failure to provide a complete <br />range of urban services to the Property after the effective date <br />of the annexation and during the tax differential period. <br /> <br />7.1 This paragraph 7 shall not apply to facilities or <br />services currently provided by the Lane Rural Fire ?rotection <br />District or the Junction City Water Control District in the event <br />that the City becomes the successor entity responsible for <br />providing services formerly provided by either entity. <br /> <br />8. Modification in writing. This Agreement may be modified at <br />any time only by the subsequent written agreement of the parties. <br /> <br />9. Bindinq Effect. This Agreement is binding on the parties and <br />on their successors in interest, including heirs, purchaser, <br />assignees, and lessees. <br /> <br />10. Covenants Runninq with the Land. Property Owner's agreements <br />contained herein, including, but not limited to, the obligations to <br />connect to the sanitary sewer system, to apply for annexation, to <br />execute additional consents to annexation, and to pay systems <br />development ,charges, are covenants running with the land and/or <br />equitable servitudes. These obligations are binding on Property <br />Owner and Property Owner's heirs, assigns and successors and run <br />wi th the Property. This Agreement, or a memorandum thereof, may be <br />recorded by either party in'the real property deed records of Lane <br />County. <br /> <br />Annexation and Urban <br />Services Agreement - Page 6 <br />
