<br />.~ <br /> <br />~\ <br /> <br />~1 . <br /> <br />11. Execution of Aqreement bv Successors. Property Owner agrees <br />to require any person or entity purchasing the property from <br />Property Owner to sign this Agreement as a condition of sale. , <br /> <br />12. Remedies. Each party has the remedies allowed in law and in <br />equity for any material breach of this Agreement. In addition, <br />each party has the following specific remedies. <br /> <br />12.1 City Remedies for Failure to Sewer or Annex. In the <br />event Property Owner fails to connect to the sanitary sewer system <br />within the time set out in Paragraph 2, re-execute a consent to <br />annexation as required by Paragraph 3.7, compel execution of this <br />Agreement by a successor property owner as mandated by Paragraph <br />11, or perform any other duty imposed under this Agr~ement and such <br />breach of duty results in a lack of connection of the Property to <br />the sanitary sewer system by the time required under Para~raph 2 or <br />failure of the Property to become annexed to the City of ~ugene by <br />the time set out in Paragraph 3, the City shall have the following <br />remedies: <br /> <br />12 . 1. 1 Occupancy and Buildinq Permits. The City <br />may revoke occupancy or building permits provided by the <br />City after execution of this Agreement, or may refuse to <br />issue occupancy or building permits, and may discontinue <br />the provision of sewer and/or water service to the <br />Property. <br /> <br />12 . 1.2 PaYment of Tax Differential. In the event <br />the breach of duty results in a failure of the Property <br />to become annexed to the City of Eugene by the time set <br />out in Paragraph 3, the Property Owner shall be liable to <br />the City for the difference between the real property ad <br />valorem taxes actually assessed against the Property and <br />the real property taxes that would have been assessed <br />against the Property had it been annexed to the City of <br />Eugene on the date of the execution of this Agreement <br />without a tax differential. Such damage liability shall <br />continue so long as the Property is not annexed to the <br />City of Eugene. <br /> <br />12. 2 Property Owner Special Remedies. In addition to any other <br />remedy available at law or in equity, the Property Owner shall have <br />the 'following remedies and obligations upon breach of this <br />Agreement by the City in the following particulars: <br /> <br />12.2.1 Failure to Provide Tax Differential. In the <br />event that the Property~is annexed to the City without the tax <br />differential required under Paragraph 4, the City shall pay <br />Property Owner or the Property Owner's successor in interest, <br /> <br />Annexation and Urban <br />Services Agreement - Page 7 <br />
