<br />RESOLUTION NO. 4551 <br /> <br />A RESOLUTION CALLING A PUBLIC HEARING TO CONSIDER <br />PROPOSED WITHDRAWAL OF TERRITORIES (McCOWEN, EC EU 97- <br />50; LOCKHART, EC EU 97-49; BENCHMARK NORTHWEST, EC EU 97- <br />52; SMITH, EC EU 97-54; SCOTT, EC EU 97-55; FLECK, EC EU 97-63; <br />HAWKINS, EC EU 97-68; GAUDETTE, EC EU 97-78; MORTHAN HOMES, <br />EC EU 97-71; PHILLIPS, EC EU 97-83; AND STUCKEY, EC EU 97-82 <br />FROM THE RIVER ROAD WATER DISTRICT AND RIVER ROAD PARK <br />AND RECREATION DISTRICT; PROPOSED WITHDRAWAL OF <br />TERRITORIES (OTT, C EU 97-35; BREEDEN LAND CO., C EU 97-36; <br />FOSTER, C EU 97-42; COOK, C EU 97-46; PRESLEY, EC EU 97-51; <br />ANDERSEN, C EU 97-56; ANDERSEN DEVELOPMENT, C EU 97-58; <br />MEIER, C EU 97-74; SHEPHARD, C EU 97-72; AND RUHOFF, C EU 97-73 <br />FROM THE SANTA CLARA WATER DISTRICT; AND PROPOSED <br />WITHDRAWAL OF TERRITORY (COONEY, EC EU 97-80) FROM THE <br />WILLAMALANE PARK AND RECREATION DISTRICT. <br /> <br />RECITALS: <br /> <br />A. The Lane County Local Government Boundary Commission by its Notice dated <br />October 30, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following <br />described real property was annexed to the City of Eugene, effective August 18, 1997: <br /> <br />A portion of Tax Lot 701, Assessor's Map 17-04-1324, located in <br />the River Road area of north Eugene, north of Carolyn Drive, and <br />more particularly described on Exhibit A attached hereto and <br />incorporated herein by reference. (McCowen, EC ED 97-50). <br /> <br />That property is contained in and is a part of the River Road Water District and the River <br />Road Parks & Recreation District. The City desires that the property so a~exed be withdrawn <br />from those Districts and that the City assume proportionate liability for the part of the Districts <br />so withdrawn. <br /> <br />B. The Lane County Local Government Boundary Commission by its Notice dated <br />October 29, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following <br />described real property was annexed to the City of Eugene, effective August 18, 1997: <br /> <br />Tax Lot 4400, Assessor's Map 17-04-24 3 1, located in the River <br />Road area of north Eugene, north of Park Avenue, south of <br />Sunnyside Drive, and west of River Road, and more particularly <br />described on Exhibit B attached hereto and incorporated herein by <br />reference.
