<br />H. The City Engineer's report and Hearings Official's minutes, findings and <br />recommendations presented to the City Council in conjunction with this matter and this <br />resolution ratify past decisions of the City Council regarding initiating the formation of the <br />local improvement district and satisfy the requirement of Section 7.160 of the Eugene <br />Code, 1971 (EC). <br />I. Notice of the public hearing regarding formation of the proposed local <br />improvement district was published in the Register-Guard, a newspaper of general <br />circulation in the City and Santa Clara area on March 5, 1996. The City Engineer sent <br />notice of the public hearing by first-class mail to owners of property in the contemplated <br />improvement district as allowed by EC 7.165(2). <br />J. As the Council's designee the Hearings Official conducted the public hearing <br />required by EC 7.166 on May 15, 1996, at which time he considered the City Engineer's <br />report, filed written remonstrances, and the testimony and evidence offered at the public <br />hearing. Prior to the hearing an information session was held May 8, 1996. <br />K. Regardless of the remonstrances filed in these proceedings, Section 37 of the <br />Eugene Charter of 1976 allows the City Council to proceed with formation of the proposed <br />local improvement district. <br />L. In the proceedings for the formation of the proposed local improvement district, <br />the City has afforded the owners of the affected property the same notice, opportunity of <br />remonstrance and all other rights and remedies which the owners of property within the <br />City have under local and state law. <br /> <br />X,U,S RESOLUTION <br />
