Exhibit D <br /> <br /> Findings for AN ORDINANCE AMENDING THE EUGENE-SPRINGFIELD <br /> METROPOLITAN AREA GENERAL PLAN DIAGRAM AND THE <br /> FAIRMOUNT/UNIVERSITY OF OREGON SPECIAL AREA STUDY DIAGRAM AND <br /> TEXT; AMENDING SECTIONS 9.8865 AND 9.9570 OF THE EUGENE CODE, 1971; <br /> ADDING NEW SECTIONS 9.4200, 9.4205, 9.4210, 9.4215, AND 9.4220 TO THAT CODE; <br /> ADOPTING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Comprehensive Plan Diagram Amendments Eugene Code Section 9.7730(3) requires that <br />the following criteria (in bold and italic) be applied to a Metro Plan diagram amendment. <br /> <br />(a) The amendment must be consistent with the relevant Statewide Planning Goals adopted by <br />the Land Conservation and Development Commission. <br /> <br />Goal 1 Citizen Involvement: To develop a citizen involvement program that insures the <br />opportunity for citizens to be involved in all phases of the planning process. <br /> <br /> The City has acknowledged provisions for citizen involvement that ensure the <br /> opportunity for citizens to be invdlved in all phases of the planning process and set out <br /> requirements for such involvement. The action taken did not amend the citizen <br /> involvement program. The process for adopting these amendments complied with Goal 1 <br /> since it complied with, and surpassed the requirements of, the citizen involvement <br /> provisions. <br /> <br /> The City of Eugene land use code implements Statewide Planning Goal 1 by requiting <br /> that notice of the proposed amendments be given and public hearings be held prior to <br /> adoption. Consideration of the East Campus Plan amendments began with a Eugene <br /> Planning Commission public heating on November 18, 2003. Department of Land <br /> Conservation and Development notice, notice to property owners and interested parties <br /> and newspaper publication was provided for that hearing. An additional public hearing <br /> before the Eugene City Council is scheduled for February 23, 2004. Notice to interested <br /> and affected parties will be provided for that heating. The process for adopting these <br /> amendments complies with Goal 1 since it complies with, and surpasses the requirements <br /> of the State's citizen involvement provisions. <br /> <br /> The City of Eugene has determined that the multiple applications to be considered will be <br /> processed as a Type V (legislative) process. The proposed amendment applications are <br /> subject to the public notification and heating processes adopted by the City of Eugene in <br /> Eugene Code section EC 9.7720 and 9.7735. The notification and heating processes <br /> required by the code have been followed, even though the City Council approved an <br /> alternative process and schedule for the East Campus Plan Amendment applications on <br /> <br /> City Council Agenda page 235 <br /> <br /> <br />
