MEMORANDUM <br /> <br />DATE: February 17, 2004 <br />FROM: Mark Schoening, City Enginee, r <br />TO: Hearings Official <br /> <br />SUBJECT: PROPOSED FINAL ASSESSMENT FOR PAVING, CURBS, GUTTERS, <br /> SIDEWALK, MEDIAN, PARKING BAYS, STREET LIGHTS, STREET <br /> TREES, AND STORM WATER DRAINAGE SYSTEM ON LONE OAK <br /> DRIVE FROM DIVISION AVENUE TO 250 FEET EAST OF LONE OAK <br /> WAY. (JOB 4058) (CONTRACT 2004-08) <br /> <br />BACKGROUND <br /> <br />Lone Oak Drive was an improved street with curbs and gutters, sidewalks and paving on the South side <br />only of Lone Oak Drive from Division Avenue east to Lone Oak Way. The improvements to Lone Oak <br />Drive between Division Avenue and Lone Oak Way were to meet the current and future pedestrian, <br />bicycle and vehicular needs in this developing area of the community. <br /> <br />The project was initiated by two petitions received by the City, in Oc}ober 1999 for Lone Oak Way <br />and in July 2002 for Lone Oak Drive. The City Engineer initiated the preparation of plans and <br />specifications, pursuant to Section 7.160(8) of the Eugene Code, 1971. <br /> <br />Bids were opened on July 1, 2003, with Wildish Construction Co. as the apparent low bidder. The <br />City Council formed the Local Improvement District (LID) on July 28, 2003. The project has been <br />completed, and final assessment costs have been calculated. The property owners were notified of <br />the pending assessment hearing ten (10) days prior to the hearing as required by Municipal Code. <br /> <br />The intent of the final assessment hearing that is scheduled for February 18, 2004, is to review the <br />final project cost, consider comments on the proposed assessments, and to provide evidence to be <br />included in the ordinance levying the assessments by the City Council. <br /> <br />CORRESPONDENCE <br /> <br />Since the mailing of the Notice of Proposed Assessment, city staffhas received two phone calls and <br />has met with one property owner. Information regarding the assessment calculations was provided <br />to Mark Cogswell (for Lone Oak Development LLC). Mr. Cogswell stated that he thought the <br />assessment was too high. Staff discussed with Wally Gustler (attorney for Harder Development III <br />LLC) the hearing process and described the estimated amount of the assessment. Mike Deines <br />(Harder Development III LLC) notified staff that he was not interested in being present at the <br />hearing. At Mr. Deines' request, staff faxed an additional copy of the proposed assessment letter to <br />him. Staff received no written correspondence expressing concerns or questions regarding the cost <br />of the improvements. <br /> <br /> City Council Agenda page 187 <br /> <br /> <br />
