In accordance with the rezoning <br />criteria above, the use of the expansion area for aggregate production must be found consistent with the <br />specific purposes of the proposed zone classification Sand, Gravel and Rock Products Zone (SG-RCP) <br />as described below. The rezone is required to show consistency with the statewide planning goals. <br />This zoning district must be applied upon demonstration that the site complies with the Goal 5 <br />Administrative Rule and mining shall be allowed. <br /> <br /> LC 16.217(1) Purpose. The intent of the Sand, Gravel and Rock Products Zone (SG-RCP) is to: <br /> (a) recognize that sand and gravel deposits within the County are an unrenewable natural resource. <br /> (b) Identify and zone under this zone major deposits of sand and gravel, rock and related material <br />resources. <br /> (c) Provide for the utilization of this resource in a manner compatible with other land uses in the area. <br /> (d) Encourage the regular, systematic and uninterrupted extraction and processing of such resources. <br /> (e) Establish procedures for assuring protection of public health and safety on and adjacent to land <br />used for extraction and processing. <br /> (f) Prevent irresponsible extraction of material resources, to the detriment of the public. <br /> (g) Provide standards to be observed during the extraction process with a view to ultimate utilization of <br />the site. <br /> (h) Carry out these purposes with the recognition of a need for said resources and the right of each <br />property owner to make a reasonable use of his or her land. <br /> (i) Implement the policies of the Rural Comprehensive Plan. <br /> (j) Be applied only to those sites which have been evaluated consistently with the statewide planning <br />goal 5 Administrative Rule conflict resolution process. <br /> LC16.217(3)Permitted Uses. In the SG-RCP zone, the following uses are permitted, subject to the <br />following restriction: For an property designated in the Eugene Springfield Metropolitan Plan as <br />significant in terms of OAR 660-16.000/025 and designated as ‘1B’, a Goal 5 ESEE consequences <br />analysis per the Goal #5 Administrative Rule must first be completed. If the landowner and County do <br />not agree on the method to achieve the Goal, the matter shall be forwarded to the Hearings Official for <br />processing consistent with LC 16.100. <br /> The ‘1B’ sites are those for which not enough information is available to determine significance. <br /> The expansion area is not a ‘1B’ site, therefore, the Goal 5 ESEE analysis is not required under the <br /> Goal 5 rule or this section of Lane Code. <br /> <br /> <br />OREGON STATEWIDE PLANNING GOALS <br /> <br /> As required under ORS 197.175(2)(a), Comprehensive Plan amendments must comply with the <br />Statewide Planning Goals. The applicant’s discussion of the Goals is found in their application. <br /> <br />Goal 1 Public Involvement <br /> The County sent notice to neighbors and referrals to agencies on October 26, 2005, 20 days prior to the <br />November 15, 2005 joint Planning Commission public hearing. The notice notified them of the <br />opportunity to comment on this request to expand the existing Delta gravel extraction operation <br />westward to the subject property. A Legal Ad announcing the November 15, 2005 public hearing <br />before the planning commissions was published in the Register Guard on October 26, 2005 and a sign <br />was placed on the subject property on that same date announcing the time, location, and applicable <br />criteria for comments. Written notice and referral was sent to neighbors, interested parties, and <br />agencies on October 12, 2006, 20 days prior to the joint public hearing before the Lane County Board <br />of Commissioners and Eugene City Council on November 1, 2006.
