<br />And Whereas~ the Viewers duly appointed by said Ordinance No. 5604 made and filed
<br />a report of their findings of benefits and damages to the property benefitted
<br />and the property damaged by the opening of said street,

<br />And Whereas, due notice of the consideration of said report was given and, ~,

<br />thereafter said report was duly adopted by Ordinance No. 5917, passed and approved

<br />April 11, 1927,

<br />And Whereas, the damages sustained in the taking of property in said street
<br />opening in the name of Florence A. Hays amounted to $500.00, and there were no
<br />benefits,
<br />
<br />And Whereas, the City of Eugene paid to Florence A. Hays the excess of
<br />damages over benefits by General Fund Warrant No. 27968, in the sum of $500.00,
<br />And Whereas, there was no further obj ections to said report of viewers,
<br />
<br />and the time for appeal from the said viewer's report has long since expired,
<br />
<br />THEREFORE, be it resolved by the Common Council of the Ci ty of Eugene that
<br />the following described property, being the property described in said Engineer's
<br />
<br />report and in said viewer's report, towit:

<br />Beginning at a point on the west line of Agate Stree t if extended south
<br />as said Agate Avenue is platted and laid out in Gross Addition to the City of
<br />Eugene, Lane County, Oregon, 334 feet South of the south line of 23rd Avenue as
<br />the same is platted and laid out in Gross Addition to the City of Eugene, Lane
<br />Co., Oregon, saidbeginnillg point being the North line of 24th Avenue in the
<br />City of Eugene, Lane County, Oregon, if extended east to Agate Street as platted
<br />and laid out in Mountain View Park Addition to Eugene, Lane County, Oregon, and
<br />running thence south 66 feet, thence west 100 feet, thence north 66 feet, thence
<br />east 100 feet to the place of beginning, all in Eugene, Lane County, Oregon.

<br />is necessary to the opening and establishing of said street and said described
<br />
<br />property is hereby taken and appropriated for the purpose of said street, and
<br />said 24th Avenue is hereby opened, laid out, and established between Agate Street
<br />West and the West line of the LaPorte property, in said City of Eugene, and the
<br />
<br />City Engineer is directed to prepare and deliver to the recorder an accurate plat
<br />of, said s tree t and of the property so appropriated for public use, andt he record-
<br />
<br />er is directed to file for record with the County Clerk of Lane County said plat
<br />and a copy of this resolution.
