<br />opening in the name of Margaret E. Kizer amounted to $500.00, and the benefits to
<br />the property in said street opening amounted to $80.00,
<br />And Whereas, the City of Eugene paid to Margaret E. Kizer the excess of
<br />damages over benefits by Gelleral Fund Warrant No. 23764, in the sum of $420.00,
<br />
<br />And Whereas, there was no further ob ject ions to said report of viewers, and
<br />
<br />the time for a.ppeal from the said viewer" s report has long since expired,

<br />THEREFORE:,' be it resolved by the COffialOn Council of the City of Eugene that
<br />the following described property, being the property described in said Engineer's
<br />
<br />report and in said viewer's report, towit:

<br />Commencing on east line of the Donation Land Claim of James Huddleston and
<br />wife Not. 2180 in Section 31 Tp. 17 S. R. 3 West of the Willamette Meridian where
<br />the center of 13th Street of Eugene extended west would intersect the same,
<br />thence south 2,3 feet, thence West 367feet, thence North 33 feet, thence East to
<br />the place of beginning, being a tract of ground 33 feet wide and 367 feet long
<br />on the North end of said party's land.

<br />is necessary to the opening and establishing of said street and said described

<br />property is hereby taken and appropriated for the purpose of said street, and
<br />said Thirteenth Avenue is hereby opened, laid out, and established between
<br />Jefferson Street and Madison 'Street, in said City of Eugene, and the City
