<br /> Minutes of the regular meeting of the ~ommon Council due to be held on ~'
<br /> Nove.lllber 11 th, but legally postponed to November 12th, because of Monday, November
<br /> Ilt~ being Armistice Day, a legal holiday. Copncil was called to order by Mayor
<br /> Large, with all Councilmen present except Rei~.
<br /> .
<br /> Minutes of the regular meetin~ of October 14th, the special meeting of
<br /> October 16th, and the adjourned meeting of Oct,ober 30th, 1935, were read and
<br /> appr.oved.
<br /> . The Judiciary Commi ttee, by Chairman Ha.rris, asked tha t bids be called for
<br /> on the leasing of the Airport on commission basis, and that the Judiciary Committee
<br /> and City Attorney be empowered to investigate the various bidders. On motion duly
<br /> seconded and carried this request was granted.
<br />. The Judiciary Committee reported on the request concerning the Hall
<br /> property, stating that this would have to bere-assessed.
<br />I The Judiciary Committee reported that the request on the Stratton property
<br /> was to be left up to W. C. Clubb to explain to them, and report back to the Council
<br /> The question of licensing the theatres was brought to the attention of the
<br /> Council, and the followin8 proposed ordinance ~as read: An Ordinance imposing a
<br /> lice.nse tax upon all shows entertainments of any character awarding a prize by lot
<br /> or chance to ticket holders, in addition to the entertainment furnished. Mr'.
<br /> e'Connell, representing the MeDonald, Rex, Heilig and M~yflower Theatres addressed
<br /> the Council expreseing his belief that Bank Nite was not a lottery, and in 44
<br /> states the courts had ruled that it was not a lottery and in their estimation it
<br /> was nothing more than a business stimulant. Jhe people did not have to buy
<br /> tickets to win, thE:: '-'linning number was announc_ed on the street and if the person
<br /> was there he would be entitled to win. Counc~lman Simon felt that they did not
<br />I want a license merely on Bank Nite, but that the theatres should be licensed.
<br /> Attorney Calkins pointed out that no matter how it was conducted it was still a1
<br /> lottery. Councilman Carlson stated that he felt the theatres should be licensed
<br /> and Jf then they felt that Bank Nite was a lottery the City could make arrests and
<br /> stop the same, but that the ordinance should not just cover the theatres, but all
<br /> kinds of business.
<br /> At this time Councilman Reid appeared in Council.
<br /> Councilman Lamb requested that the Mayor return this to the Committee for
<br /> them to meet with the representatives of the theatres and report back definite
<br /> recommendations at the next Council meeting.
<br /> Councilman Reid stated that apparently a report had been brought in by the
<br /> Judiciary Committee, but he wanted to say that he had not met with the Committee
<br /> at all. Councilman Harris, Chairman of the Committee, stated that he had intended
<br /> to call him.
<br /> It was then moved that this be referred back to the Committee, and it was
<br />.' seconded and carried.
<br /> The Judiciary Committee asked that the Council request the Police Committee
<br /> and Police Department to enforce the Curfew Ordinance No. 1490, and Ordinance No.
<br /> 8247 on clairvoyants. Councilman Lamb moved that they be enforced, and the motion
<br /> was seconded and carried.
<br /> The Finance Committee, by Chairman Hendershott, moved that the Council
<br /> request the Recorder to call for bids for the annual audit of the 1935 records.
<br /> Said bids to be opened at the December 9th Council meeting. Motion was seconded
<br /> and carried. )
<br /> The Finance Committee, by Chairman Hendershott, presented the following
<br /> bills to the Council with a recommendation that they be allowed. Motion was made
<br /> and seconded that warrants be drawn for the same. The ayes and nays were called,
<br />I Councilmen voting aye 8, nay none, absent none. (
