<br /> Minutes of the adjourned meeting of the Common Council, held at the hour of

<br /> 7:~0,o'clock P.M., November 25, 1935. Council was called to order by Mayor Large, '.....
<br /> with all Councilmen present except Reid and Harris. .
<br /> Councilman Bond, Chairman of the Fire and vTater Commi ttee, recommended to the
<br /> ! Mayor the appointment of Dale Croner to take the position made vacant in the Fire
<br /> Department by the resignation of Jack Hayes, as of December 1, 1935. The Mayor
<br /> accepted the recommendation and appointed Mr. Croner. Motion was made, seconded
<br /> and carried to confirm the appointment, and the Recorder instructed to place Mr.
<br /> Croner on the Payroll as of December 1, 1935 and draw a warrant for his salary at
<br /> the same time other salaries are paid.
<br /> Councilman Zumwalt reported that they had given one elk to the Salvation Army
<br /> . for Thanksgiving and they wanted another one for ChristmaB, and that they would get
<br /> rid of the third one.
<br /> Councilman Zumwalt moved at this time that the bear herd be reduced to two,
<br /> bears. This was seconded and carried. Councilman Hendershott pointed out that Mr.
<br /> Gus Peret of Yoncalla had loaned one of these bears to the City, and he should be
<br /> contacted before disposing of his bear. The Recorder was instructed to write Mr.
<br /> Peret.
<br /> At this time Councilman Harris appeared in Council.
<br /> Councilman Harris, Chairman of the Judiciary Committee, asked for more time on
<br /> the theatre situation and the Airport lease. This was granted.
<br /> I A communication from Mrs. Hettie J. Robinson, Jr. , concerning her claim for
<br /> I damages for injury received from a fall on the sidewalk in front of the Methodist
<br /> I Church, 1liaS read as follows: $100.00 general damages; $17.50 Doctor bill; $16.00
<br /> house help; and $4.00 laundry. Total ~137.50. This was referred to the Judiciary
<br /> I 60mmittee and City Attorney.
<br /> A communication from the Zoning Board of Appeals recommending that the request
<br /> of Orlan L. Crabtree to bank about 60 cords of wood at his residence at 1130 West
<br /> 6th Ave., be denied. Motion was made, seconded and carried to adopt thds recommend
<br /> ation.
<br /> The report of the City Engineer and City Attorney on the Hawkins and Roberts
<br /> request for the cancelJation of interest on assessments on the West 40 feet of the
<br /> South 80 feet of Lot 15, Block 7, Gross Addition, was presented, and upon their
<br /> recommendation, it was moved, seconded and carried to deny the request.
<br /> The summary of the Eugene Water Board claim for placing the rental of their
<br /> quarters by the City at $150.00 per month, was presented and it was moved, seconded
<br /> and carried that their report be adopted.
<br /> At this time Councilman Reid appeared in Council.
<br /> . Reports f or the months of September and Oc t'ober from the Pol ice Matron were
<br /> presented and ordered filed.
<br /> Communication from Representative C. F. Hyde was presented to the Council,
<br /> concerning his receipt of the memorial to the State ~egislature by the Council.
<br /> An Ordinance ordering a special election for submitting to the electors of
<br /> the City of Eugene, at such special election to be held on the 31st day of
<br /> January, 1936, the following proposal: "Shallthe Common Council of the city of
<br /> Eugene adopt a system of civil service for its fulltime paid fire fighters, and
<br /> make all necessary provisions therefor? II , was read the first time and discussion
<br /> was lead by Councilman Lamb. He wanted to know if this had to be voted on at the
<br /> next election on January 31, 1936. The Mayor stated that it coUld be postponed.
<br /> Councilman Lamb then expressed the opinion that this should be postponed. Council-
<br /> man Carlson pointed out that it was his underBtanding that this had to be voted
<br /> I on at this time, and if the Imv read that~'way the Council should abide by it. Mr.
<br /> Jaclc Haye s, representing the Firemen's Association, addressed the Council stating
<br /> that this Association was responsible for the enactment of this law, and that the
<br /> intent of the Legislature at the time of its passage was that this should be voted
<br /> on at the nett general olection as a special measure, but if there was a special
<br /> election in the meantime it should be voted on then. Councilman Carlson asked the
<br /> City Attorney to explain Chapter 122 of the 1935 Session Laws, and he did so,
<br /> pointing out that was worded that it must be done at this corning special election,
<br /> but he also pointed out that the Council was a legislative body such as the
<br /> legislature itself, and that they could probably do as they saw fit about it, and
<br /> the only recourse would be by mandamus action through the courts ordering the
<br /> Re~order to place the same upon the ballot. Councilman Carlson said that in his
