3.2 Conduct business in such a way as to restrict or interfere with the enjoyment <br />or use of property or nearby property owners or occupants; <br />3.3 Create a hazard to life or property; <br />3.4 Conduct business within 100 feet of another merchant or vendor selling <br />substantially similar items, except with the written consent of that merchant or vendor. The <br />written consent of the merchant or vendor must be delivered to the City Manager or <br />designee prior to the issuance of a license hereunder, and once given, may not be revoked <br />prior to expiration of the term of the license by such merchant or vendor with regard to <br />such applicant if a license is granted to that applicant; <br />3.5 Operate within ten feet of any crosswalk; <br />3.6 Operate on a sidewalk adjacent to a contra -flow bicycle lane or within ten <br />feet of any travel lane, except for peddlers without equipment, and peddlers with equipment <br />so small it does not create an obvious obstruction. Equipment must be carried on the <br />peddling vendor's person; <br />3.7 Operate or display wares in an area adjacent to East 13th Avenue between Kincaid Street <br />and Hilyard Street, or adjacent to Alder Street from the alley north of East 13th Avenue to the alley <br />south of East 13th Avenue. <br />R -3.336-N Specifics for Downtown Activity Permits. <br />1. Scope. This Rule supplements the requirements of the Eugene Code, 1971, and <br />applies to commercial pursuits, and to activities, events, and performances for which admission is <br />charged and are conducted on public property within the Downtown Activity Zone. <br />2. Prohibited Activities. In addition to any other prohibitions in this Rule, the <br />following activities are prohibited on public pedestrian areas within the Downtown Activity Zone: <br />2.1 Commercial Pursuit. No person shall engage in a commercial pursuit <br />except as authorized by EC 3.344(4) and this Rule, or pursuant to other specific permission <br />granted by the City Manager. <br />2.2 Noise. No person shall operate or use any noise -producing machine, <br />vehicle, or mechanical or electrical device in a manner that creates a noise disturbance or <br />interferes with any authorized activity, except when engaged in an authorized activity and <br />the noise is both authorized by the permit and reasonably necessary to the authorized <br />activity. <br />2.3 Vandalism and Litter.
