2.3.1 No person may mutilate, deface, damage, or remove a table, bench, <br />building, sign, marker, monument, fence, barrier, fountain, faucet, traffic recorder, <br />or other structure, facility or improvement of any kind; and, <br />2.3.2 No person may dig up, deface or remove earth, stones, rock, plants, <br />or other substance, make an excavation, lay or set off any blast, roll any stones or <br />other objects, or assist in doing so; and, <br />2.3.3 No person may litter by throwing or depositing refuse or causing <br />refuse to be thrown or deposited in the public space without providing for its proper <br />disposal. <br />3. Location of Activities. To preserve pedestrian access and safety, and to support <br />uses that encourage participation in the Downtown Activity Zone, unless the City Manager makes <br />a specific finding that another portion of the Downtown Activity Zone will best accommodate an <br />activity, the following areas shall be the preferred locations for the listed activities: <br />3.1 On sidewalks: <br />3. 1.1 Authorized activities by an owner or tenant of the abutting property; <br />3.1.2 Cafe seating; <br />3.2.3 Pushcart vendors; <br />3.2.4 Street entertainment; <br />3.2.5 Personal solicitations; and <br />3.2.6 Newspaper dispensers. <br />3.2 In the Park Blocks and designated locations within the Broadway Plaza: <br />3.2.1 Pushcart vendors; <br />3.2.2 Activities, events, and performances which involve more than a total <br />of 25 persons at any one time; <br />3.2.3 Street entertainment; <br />3.2.4 Fund raising activities or personal solicitations; <br />3.2.5 Newspaper dispensers; and <br />3.2.6 Other commercial pursuits for which a Downtown Activity Permit <br />has been issued. <br />Administrative Order - Page 19 of 29 <br />
