4.2.1.2.2 No Downtown Activity Permit has been <br />issued for the same location or no application is then being <br />considered for the same location, <br />4.2.1.2.3 The City Manager approves the signage, the <br />method of displaying merchandise, and the design of display racks <br />and tables, <br />4.2.1.2.4 In the event that the abutting property is <br />occupied by two or more persons or businesses acting as separate <br />occupants, the application for a permit is accompanied by a written. <br />statement from the owner of the property showing approval of the <br />application, and, <br />4.2.1.2.5 Where awnings exist that provide pedestrian <br />rain cover, the authorized activity shall provide three feet of <br />pedestrian passage area under the awning in the event of rain; <br />4.2.1.3 Cafe seating on a sidewalk by a restaurant occupying <br />abutting property and: <br />4.2.1.3.1 The caf6 seating is parallel to the permittee's <br />storefront, <br />4.2.1.3.2 If the permittee proposes cafe seating that <br />would extend to the front of an adjacent storefront, consent must be <br />granted by the adjacent store owner, <br />4.2.1.3.3 The City Manager approves the design and <br />color of the tables and chairs, <br />4.2.1.3.4 In addition to standards set forth in R -3.336- <br />N-4.1.8.1, the tables and chairs are maintained in good repair and <br />appearance, <br />4.2.1.3.5 The permittee takes full responsibility for <br />refuse that is generated by the use of the cafe seating. A suitable <br />receptacle shall be provided by the permittee and emptied by the <br />permittee. Tables shall be cleared of refuse immediately after they <br />are vacated, <br />4.2.1.3.6 The permittee may not sell alcoholic <br />beverages on a sidewalk except as authorized by a license from the <br />Oregon Liquor Control Commission, and, <br />Administrative Order - Page 24 of 29 <br />
