J. Hanns moved that the council take proper steps to place the <br />_~ $34~023.08, cash surplus, in the general fund into the sinking fund for payment of <br />~. principal and interest on Improvement Bonds. Mayor Large did not believe this <br />:~ could be done and asked City attorney Calkin~ for an opinion. Mr. Calkins stated <br />'.- that he could not make a definite decision upon such shQrt notice, but his opinion <br />off-hand was that this one account was all surplus of moneys not expended in 1937 <br />and other excess collections, but that it would be impossible to use this account <br />for any of the 1937 requirements or to set it aside in a sinking fund without first <br />going through a regular budget procedu~e. It was further his opinion that this <br />fund could be invested by the Finance Committee so that additional income might be <br />had, but that when the budget for 1938 is prepared that amount of tax levy would be <br />reduced by this sum of money. The matter was referred to the Finance Committee and <br />City Attorney for further discussion. <br /> <br />,:.iIiI. <br />~ <br /> <br />(33 <br /> <br />\. <br /> <br />Councilman Hendershott stated that it was compulsory that anyone desiring.to <br />cut down trees in any locality in the city of Eugene should first get permission <br />{34 from the Park Board. <br /> <br />It .was the recommendation of the council that all gasoline contracts, hereto- <br />fore submitted, be executed by the Mayor and Reconder on the condition that each <br />contract contain the two following clauses: (1) the city reserves the right to <br />purchase any or all of its gasoline needs; (2) in'event of reduced prices, the city <br />is to receive the benefits of the prices. It was understood that the city will <br />\ Imake its purchases as nearly as practicable on an equal gallonage basis from the <br />351 various companies~ ' . ' <br /> <br />II Letter from James A. This was referred to <br />37 the Street Committee. <br />I <br /> <br />II An ordinance prohibiting the use of heavy vehicles in the park~ of the city <br />Ilof Eugene was read the first time and passed to its second and third readings by <br />,unanimous consent of the council by title under suspension of the rules and was <br />.~placed on its final passage. The ayes and nays were called, councilmen voting aye, <br />I,Lamb, Hendershott, Reid, Bond, Carlson, Hanns, Page and Farrington; n~y, none; <br />38 absent, none.
