~ 69 I I I I I .. __... ~ 'n f 30 (31 132 133 / 34 J 36 WHEREAS, The Common Council referred the settlement of the application to a committee composed of the Finance Committee and the Judiciary Committee, and WHEREAS, the Committee so appointed has made a report re- commending that the city accept the amount due it from Mr. Washburne and issue a deed upon guarantee being furnished that the insurance premiums will be assumed and paid. - t~ ~f !t:1' ..:~ 'w'l.., NOW, THEREFORE, BE IT RESOLVED, By the Common Council of the City of Eugene that the Mayor and the Hecorder be and they are hereby directed to make, execute and deliver on behalf of the City of ~ugene a bargain and sale deed without coven- ants to the ~ugene Bible University property, to Claude Wash- burne and to deliver the deed to him upon assurances being received that the fire insurance premiums on the fire insurance on the buildings will be assumed and paid by the purchaser. Request of the Vermont Loan and ~rust Company to renew the easement per- mitting joint use of the driveway area on their property described as:I1Beginning at a point in the West line of Fairmount Boulevard in the Gity of ~ugene at the N. E. corner of the S. 35.2 feet of Lot 2, Block 22 in Fairmount, now a part,of the City of Eugene, Lane County, Oregon, according to the original plat thereof, and running thence West 96 feet; thence South 50 feet; thence East to the ~est line of said Fairmount Boulevard in said City, and thence following the West line of said Fair- mount Boulevard northerly to the place of beginning',11 and which driveway encroaches to a small extent on the land owned by the city, was referred to the Judiciary Committee and City Attorney. Communication from Donald M. Erb extending his appreciation to the council for their word of welcome to the neWly-appointed president of the University of Oregon, was read and ordered filed. Request of O.H. Bray to be allowed to wreck the service station and apart- mBnt building located at the SE corner of the intersection of High Street Bnd 3rd Avenue east and to rebuild the service station and extend the present tire repair shop, the latter building to be frame construction with stucco walls on the east and south, was granted by the Board of Appeals and this action: sustained by the council. Letter from E. C. Husby requesting permission to enlarge his service sta- tion and grocery store located at 290 Thirteenth Avenue East, was granted by the Board of Appeals on the condition that the construction be subject to the approval of the ~ngineer's Department and this action was sustained by the council. Request of Sher Khan for permission to build a temporary structure on the north sid~ of his building located at 642 Oak Street was granted by the Board of Appeals on the condition that the construction is approved by the Engineer's Depart ment and the permit be limited to two years. This action was accepted by the coun- cil. 35 Reports for the month of March were received from the Engineer, Police and Fire Departments and were ordered filed. Resolution authorizing the Mayor and Recorder to execute a deed on behalf Bf Dr. E. E. Gray, was upon motion made and seconded, duly adopted~ RES 0 L UTI 0 N . WHEREAS, The City of Eugene has acquired the West 55 feet of Lots 5 and 6, Block 24, Gross Addition to ~ugene, Lane County, Oregon, and ~HEREAS, the City of Eugene has caused the same to be ap- praised and determined its value, and WHEREAS, Dr. Edward E. Gray has offered the City $650.,00 for said property, which according to the appraisement is all that the property is worth, NOW, THEREFORE BE IT RESOLVED, By the Common Council of the City of Eugene that the Mayor and Recorder be and they are hereby directed to execute a bargain and sale deed to Cr. Edward E. Gray for the above described property and to accept in payment there- for the sum of $650.00. ~
