<br />1".J The minutes of the regular meeting of the Common Council held at the hour
<br />~ of 7:30 o'clock P.M., May 9, 1938. Mayor Large called the meeting to order. Counci -
<br />men present were: Messrs. Lamb, Hendershott, Reid, Page, Hanns, Farrington and Bon j
<br />1 absent, Mr. Carlson., . -

<br />The minutes of the previous meeting April 25, 1938 were presented and 01'-
<br />2 dered filed.

<br />At the request of Harry Abele, 234 ~est 7th Avenue, the Council voted to
<br />re-zone the half block covering Abele's property from Zone2to Zone 3, making it pas
<br />sible for him to erect two duplex residences at a lower fire insurance rate. Petiti n
<br />from adjacent property owners voicing their approval of such a construction, was
<br />also presented. An ordinance amending Section 2 of Ordinance #6860 entitled "An
<br />Ordinance d~claring the entire City of the City of Eugene to be a fire district and
<br />dividing the said fire district aforesaid into four fire zones to conform to the
<br />building code of the City of Eug~ne, and repealing all ordinances and parts of ordi
<br />nances in conflict herewith.", passed by the Common Council and approved by the
<br />Mayor May 14, 1928, by amending the description of Fire Zone #2, and repealing Ordi
<br />nance No. 7445 and all other ordinances and parts of ordinances in conflict herewit
<br />had its first reading, and passed to its second and third readings by title under
<br />suspension of the rule by unanimous consent of the council and was placed for final
<br />passage. The ayes and nays were called, councilmen voting aye, Lamb, Hendershott,
<br />Reid, Page, Hanns, Farrington and Bond;nay, none; absent Carlson. The ordinance wa
<br />declared passed and numbered 8537.

<br />Frank L. Chambers, owner of the Yates Hotel, against which condemnation
<br />proceedings are being instituted, made a plea to the council for the welfare of his
<br />tenants, whom he asserted were unable to find cheaper places of residence. He was
<br />granted two weeks' time in'which to comply with sanitation ~nd fire inspection re-
<br />quirements as stipulated by' Sam Mosher, Building Inspector.

<br />Mrs. Jennie L. Frasier, owner of Joe's Place, located at 57 6th Aven~e Eas ,
<br />also subject to condemnation, was granted two weeks' time to comply with the pro-
<br />visions of the city ordinance when she pleaded for time in which to protect her in-
<br />terests in the property.

<br />Fred Lamb, member of the Street Committee, reported that Dr. F. M. Day, ha
<br />been granted a permit to cut the curb at 11th and Charnelton as follows, to-wit:
<br />36 feet on 11th and 30 feet on Charnelton. Mr. Lamb stated that up to the present
<br />time, Dr. Day had refused to accept this grant and requested a further 15 feet.
<br />The council suggested that Dr. Day extend his property to include the driveway that
<br />iS,now adjacent thereto. No further action was taken at this time.

<br />With reference to the request of the Vermont Loan and Trust Company in re-
<br />gard to the easement between two Fairmount Boulevard properties, Mr. Lamb, chairman
<br />of the Judiciary Committee, reported that after an investigation of the situation,
<br />they have determined that the city do nothing with respect to the request. He
<br />stated that it was their belief that the city property and adjoining property were
<br />better off without such an agreement. Upon motion made and seconded, this reCOIDIDen a-
<br />7 tion was unanimously approved.

<br />The Finance Committee reported the following bills to the council with a
<br />recommendation that they be allowed and motion was made, seconded, and carried that
<br />warrants be drawn for the same. The ayes and nays were called, councilmen voting
<br />aye: Lamb, Hendershott, Heid, Hanns, Page, Farrington, and Bond: nay, none; absent,
