<br />abutting on said property a large scale for weiching trucks, wagons, etc. and
<br />subsequently the scale was sold by the owners to a person other than the owner of
<br />the real estate and at this time, at the instance of th owners of the real estate,
<br />the scale is being removed as being an obstacle to the proper use of their real
<br />estate and the Common Council is acquiescing in said removal provided that the
<br />owners of the real estate will replace the pavement in the sane condition it 'IV as
<br />before they were permitted to install the scales.

<br />And Whereas, the Common Council of the City of Eugene, Oregon by 0rdinanc
<br />Number 8605 passed by the Common Council on the 12th a ay of June, 1939 and approved
<br />by the Mayor on the 16th day of June, 1939 e.eclared its intention to constru.ct and
<br />declared it to be expedient that the situs of said scales be fi~led in and
<br />covered with pavement and that theproperty abutting upon said improvement is the
<br />property above first descrioed.

<br />NOW, THEREFORE, the undersigned owners of the above-described property
<br />hereby consent that the City of Eugene, Oregon may fill in and reconstruct the pavin~
<br />in the scale pit and let the contract therefore in any manner it deems most advantag
<br />eious and without advertising for bids therefor, and we hereby waive notice to build
<br />such sidewalk and pavement and also notice of the assessment against said property
<br />for the construction of the same, including engineer's charges, and hereby expressly
<br />waive any and all irregularities in the proceedings and hereby ratify and confirm
<br />all that may be done in the premises and consent that the costs of the construction
<br />of said improvement, inc1ud ing engineert's charges for superintendence and inspection
<br />not to exceed fifteen per cent of the cost of construction of said wmprovement may
<br />be tissessed against said described property and shall constitute a lien thereon as
<br />provided by the charter of the City of Eugene.

<br />An Improvement Ordinance for repairing Park street where scales had been
<br />removed was presented to the council for its first reading, and passed to its
<br />second and third readings by title under suspension of the rules by unanimous
<br />consent of the council and was placed for final reading. The ayes and nays were
<br />called, councilmen voting aye: Lamb, Heid, ~ond, Carlson, Farrington, Hanns, Page
<br />and Koppe, nay: none; absent; none. The Ordinance was aeclared passed and
<br />numbered 86Q5. .
