<br /> As to the George W. and Gladys Boqua property, City Attorney Calkins reported
<br /> ....F} that the original options had been for $7000 and that following the signing of the I
<br /> f:+:;S original options, Mr. and Mrs. Hoqua were called upon and the price reduced to
<br /> Au.;: $6400. However, the changes in the options had not been initialed and therefore the

<br /> ('O city, in his opinion, was bound by the original option price of $7000. It was the
<br /> determination of the Mayor and City Attorney that the city should stand on the orig-
<br /> inal option price of $7000. Because of this condition Mr. Calkins wished authority,
<br /> if necessary, to file suit on the property, which authority was granted by the
<br /> resolution adopted in the previous paragraph.
<br /> Mr. Cal~ins further reported that all other options had been taken up I
<br /> and contracts entered into.
<br /> Upon motion made by Councilman, Reid, seconded by Councilman ~ond,
<br /> the Mayor and City Recorder were authorized to issue warrants covering the purchase
<br /> price of the Hurzeler' and Boqua properties; said warrants to be made out to the name
<br /> of Elisha Large, Mayor, ~n order to cash the warrants and have available money for
<br /> the filing of suits in case it became necessary. It was unanimously approved.
<br /> Motion was made and seconded authorizing the Mayor and City Hecorder to
<br /> issue necessary warrants' for the purchase price of all other pieces of property as
<br /> the occasion arose.
<br /> City Attorney Calkins then stated that the contract forms had been
<br /> presented to and approved by the representatives of both banks.
<br /> Resolution was presented authorizing the Mayor and City Recorder to execute
<br /> the contract and issue warrants, depositing the contract and warrants in the First
<br /> National Bank of Eugene for the ~am C. ~ond and ~sther E. Bond property. A resoluti n
<br /> was also presented pledging the full faith and credit of the City of Eugene to
<br /> the orderly issuance of the warrants and payment thereof and expressly agrees 'with
<br /> the banks aforesaid that they will, themselves, defend any litigation, should any
<br /> arise, which in any way effects ~the validity of the warrants or impairs in any way
<br /> the safety and security of the banks in taking up the warrants and paying for them.
<br /> Motion was made and seconded unanimously approving both resolutions.

<br /> BE IT RESOLVED, BY the Common Council of the vity of Eugene
<br /> that the Mayor and the City Recorder be and they are hereby authorized and
<br /> directed to make, execute and deliver the hereto attached contract and to
<br /> issue warrants upon their airport fund in conformity with the provisions
<br /> of the contract, and deposit the contract and the warrants in The
<br /> l"irst National Bank of ~ugene, of Eugene, Oregon.

<br /> WHEREAS, the City of ~ugene, acting through its Common
<br /> Council. under authorization of the electors at the election of
<br /> November 5, 1940, has purchased certain properties constituting a site
<br /> for an airport, and
<br /> WHEREAS, in order that the city may complete the purchase,
<br /> a series of contracts have been entered into with the sellers providing
<br /> that upon their depositing a deed and an abstract showing marketable title,
<br /> free of incumbrances, that the city will, as soon as it conveniently can,
<br /> examine and approve the title, issue warrants for the purchase price, and
<br /> WHEREAS, the First National ~ank of Eugene and the United I
<br /> States National Hank of Portland tOregon) through its Eugene Branch,
<br /> have agreed to take over the warrants so delivered to the sellers
<br /> and to give the sellers cash therefor,
<br /> BE IT RESOLVED that the Common Council of the City of
<br /> Eugene does hereby pledge the full faith and credit of the
<br /> City of Eugene to the orderly issuance of the warrants and the
<br /> payment thereof and expressly agrees with the banks aforesaid
