<br />~ <br />413 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />- -- -- --- - -- <br />--~-~---=--~"-..:;:~_. ~---':'~:;;'''':~~---:~"":,,,-.'-:,-~-,--=..-.;.... --_.=~-~:~-- --.-,;------~. .~ ~~~~ --~~_---.:....: =.--=-.....:.=...~~-~~~~~.:;:.-.;;:.;-~---==--_.::...:_-=---=--:-~---- -~:...--;.-~;~~.;;.'::.:.; <br /> <br /> <br /> <br />RESOLUTION <br />---------- <br /> <br /> <br /> <br />1 ~ <br />. ~~. <br />bE IT RESOLVED, by the Cmnmon Council of the City of Eugene ~. <br />that the Mayor and the vity Recorder be and they are hereby .~ <br />authorized and directed to make, execute and deliver " <br />thex hereto attached contract and to issue warrants upon their <br />airport fund in conformity with the provisions of the contract, <br />and deposit the contract and the warrants in The First National <br />Bank of Eugene, of Eugene, Oregon. <br /> <br />IRE SO L UTI ON <br /> <br />WHEREAS, the City of Eugene, actlng through lts Common <br />Council under authorization of the electors at the election of <br />November 5, 1940, has purchased certain properties constituting <br />a site for an airport, and <br /> <br />WHEREAS, in order that the city may complete the pur- <br />chase, a series of contracts have been entered into with the <br />sellers providing that upon their depositing a deed and an <br />abstract showing marketable title, free of incumbrances, that <br />the city will, as soon as it conveniently can, examine and approve <br />the title, issue warrants for the purchase price, and <br /> <br />WHEREAS, the First National Bank of Eugene and The <br />United States National bank of Portland (Oregon) through its <br />Eugene branch, ha*.e agreed to take over the warrants so delivered <br />to the sellers and to give the sellers cash therefor, <br /> <br />~E IT RESOLVED that the Common uouncil of the uity of <br />Eugene does hereby pledge the full faith and credit of the <br />City of Eugene to the orderly issuance of the warrants and the <br />payment thereof and expressly agrees with the banks aforesaid <br />that they will, themselves, defend any litigation, should any <br />1-. arise, W.hiCh in any way affects the validity of the warrants <br />or impairs in any way the safety and security of the banks in <br />taking up the warrants and paying for them. <br /> <br />Resolution was presented authorizing the Mayor and City Recorder to <br />execute the contract and issue warrants, depositing the contract and warrants <br />in the First National Bank for the purchase of the property from Hugh Cassidy <br />and Marian Cassidy; and Harry McAllister and ~ertha McAllister, respectively <br />hus band and wife, and ultver J:i'osback, a single person, lIlOCX:tXEZX!1II:tX:tNEx:f:kx:,llrt <br />lIlocx:t.
