<br /> 1NHEREAS , the City of ~ugene, acting through its Common
<br /> Council under authorization of the electors at the election of
<br /> I November 5, 1940, has purchased certain properties constituting
<br /> a site for an airport, and
<br /> WHEREAS, in order that the city may complete the pur-
<br /> chase, a series of contracts have been entered into with the
<br /> se113rs providing that upon their depositing a deed and an
<br /> abstract showing marketable title, free of incumbrances, that
<br /> the city will, as soon as it conveniently can, examine and approve
<br /> the title, issue warrants for the purchase price, and
<br /> WHEREAS, the .ff'irst National Bank of Eugene and The
<br /> United States National Bank of Portland (Oregon) through its
<br /> Eugene branch, have agreed to take over the warrants so delivered
<br /> to the sellers and to give the sellers cash therefore,
<br /> BE IT RESOLVED that the Common Council of the City of
<br /> Eugene does hereby pledge the full faith and credit of the
<br /> City of Eugene to the orderly issuance of the warrants and the
<br /> payment thereof and expressly agrees with the banks aforesaid
<br /> that they will, themselves, defend any litigation, should any
<br /> arise, -which in any way affects the validity of the warrants
<br /> or impairs in any way the .safety and security of thebanks in
<br /> taking up the warrants and paying for them.
<br /> I Resolution was presented authorizing the Mayor and City Recorder to execute
<br /> the contract and issue warrants, depositing the contract. and warrants in the
<br /> Eugene Branch of the united States National Bank of Portland (oregon) for the
<br /> purchase of the John H. Bernards and Agnes V. Bernards, property. A resolution
<br /> pledging the full faith and credit of the Ui~y of Eugene to the orderly issuance of
<br /> the warrants and payment thereof was presented. Motion was made and reconded
<br /> unanimously approving both resolutions.
