<br /> '~ The minutes of the regular meeting of the Common Council, held Monday evening

<br /> r .", at 7: 30 P. M. All councilmen were present except W.L. Davis.
<br /> Councilman Hawn stated that Mr. Lewis was present and was asking permission to show
<br /> a trained gorilla the rest of this week and over Sunday. Mr. Lewis proposed
<br /> to give the" Civilian Defense 20% of the gross revenue and was willing to make a
<br /> deposit of $100.00 in advance and was aSking that no license be charged by the
<br /> 1 City for the show. Admission charges to be l5~ adn 25~. The show would be mounted
<br /> .on a trailer 17 by 28 feet and Mr. Lewis was asking to occupy space in Broadway ju
<br /> west of Willa~ette Street, either on the North or South side of Broadway. The traf ic
<br /> hazard for a vehicle of this size at this location was pointed out and other locat-
<br /> ions were suggested. A motion was made by Hawn and seconded by Brownson that Mr.
<br /> Lewis be granted permission to show and the location to be satisfactory to the Chie
<br /> I of Police. On vote this motion was carried.

<br /> I A petition was presented by J. E. Leach that the Dog Pound be moved from its
<br /> I
<br /> , present location at the southwest corner of the old airport. The signatures on
<br /> ,
<br /> , this petition were all from out of town residents. It was claimed there was so
<br /> .,
<br /> I much barking and howling from the d9gs that it was impossible for the people living
<br /> 2 I in that neighborhood to get any sleep. Mr. Leach suggested that the pound be moved
<br /> I
<br /> '! to the Southeast corner Of the airport. Councilman Hawn explained that there was 0 ly
<br /> a limited amount of money to spend in locating the pound and that it had to be
<br /> placed close to the raod and where water could be secured. Mr. Hawn said it would
<br /> probably take from $400.00 to $500.00 to build a road'- lay a water pipe and move
<br /> the building to the S. E. corner of the filed. After some discussion a motion was
<br /> ma de, seconded, and carried that the petition be placed on file.
<br /> Councilman Koppe, chairman of the Judiciary Committee, reported regarding the
<br /> new franchise to be granted the Pacific Telephone and Tele~~ graph Company.
<br /> Mr. Koppe stated that the committee had met with the City Attorney and discussed
<br /> the situation and that a written majority report had been signed and filed with
<br /> the City Recorder. The Recorder read the report which provided that instead of
<br /> the present annual charge of $250.00 that an annual franchise charge of 2% on I
<br /> the gross earnings of the Pacific Telephone and Telegraph Company be made,
<br /> , excluding therefrom long distance tolls and also City telephones, making the
<br /> j charge on the telephone service within the. boundries of the City. Mr. Koppe
<br /> also suggested that in place of the present seven free phones furnished by the
<br /> Telephone Company, that there should be one free phone furnished for each 1500
<br /> population. Councilman Hawn making a mmnority report for the JUdiciary Committee
<br /> 3 objected to the idea of a flat 2% charge on the gross earnings of the company.
<br /> I He stated that he vfavored only a small annual charge in order that the City
<br /> I could have control over the Company. He cited the fact that the recent legislature
<br /> ,
<br /> I had placed only a 3%levy on municipal utilities and that they did not pay
<br /> I taxes while the telephone companYhdoes pay regular tax levies on their assessed
<br /> ,
<br /> I valuation. He suggested that a 3$ gross revenue charge might be made and then
<br /> ,
<br /> deduct the amount of taxes paid by the telephone company. Councilman Stewart
<br /> , said it did not appear reasonable for the telephone company to expect that the
<br /> I
<br /> I
<br /> ! franchise would be renewed under the same conditions as was granted 25 years ago.
<br /> r Councilman Farrington and Koppe stated they did not think Mr. Hawn's comparison
<br /> ! w~th the rate charged Municipal Utilities was a fair comparison. Counciiliman
<br /> ~l Crumbaker stated he thought Mr. Hawn's argument was fair. Councilman Brownson
<br /> 'I
<br /> I said he favored some other approach than the flat 2% charge. A motion was made,
<br /> ,
<br /> seconded, and carried, that the ordinance as prepared by the Pacific Telephone
<br /> and Telegraph Company be Changed to comply with the written majority report of
<br /> the Judiciary COmIuittee and also be changed in regard to the free phones from
<br /> I the suggested seven free phones to one free phone for every 1500 population. Th,e
<br /> ! ordinance was so changed and was read the first time and laid over and the
<br /> I Recorder ,was instructed to publish the required three weeks notice in the Eugene
<br /> ,
<br /> ; Register Guard.

<br /> : The Finance Committee reported on the property offers as follows: Offer of
<br /> P.J. Hanns, $1200.00 for Lots 4 and 5, Block 3, Rughs Addition was accepted, the
<br /> 4 $1200.00 to be net to the City. Offer of James S. Willcox, $800.00 for Lots
<br /> 9, 10, and 11, Block 30, Driverton Addition was rejected and counter offer of
<br /> $1,200.00 made. Offer of J. F. Newman $75.00 for Lot 8, Block 22, City Outlook
<br /> Addition, $50.00 for Lots5 and 6, Block 22, same addition was rejected and counter I
<br /> offer of $75.00, net to the City, on Lots 5, 6, 7, 8, Block 22, Ci ty Outlook
<br /> Addition was made.
<br /> I Councilman Farrington stated an investigation regarding complaints about the
<br /> ,_
<br /> I alley running north and south in the block between Potter and University and between
<br /> I
<br /> ,
<br /> i 21st add 22nd Streets had been made. He stated that the alley was partially
<br /> 5 I grown up with shrubbery and part of it had even been planted to lawns and
<br /> ,
<br /> , that the recent complaints were justified in that the alley could not be used in
<br /> .1 its present condition. The Recorder was instructed to notify the property owners
<br /> I
<br /> , that they would have to get together and clean out the alley, or it would be
<br /> necessary for the City to open the alley and assess the costs to the abutting
<br /> property.
