<br />"BE IT RESOVlED by the Common Council of the City of Eugene: That it
<br />is deemed expedient by the Common Council that the alley between 4th Avenue West
<br />and 5th Avenue West from Blair Boul'evard to Tyler Street be opened and the City
<br />Engineer is therefore directed by him or some competent surveyor to make a survey
<br />of such alley and to mark the boundary thereof and to make a plat of the same
<br />and a written report containing a full and complete discription of such alley
<br />and the boundaries thereof and any lot or tract or portion thereof to be appro-
<br />priated therefore and to file with the recorder of the City of Eugene within
<br />twenty days from the date of this resolution unless further time shall be granted
<br />therefor."

<br />The City Manager submi tted Ordina nc e 8534 and 8536 pa ssed by the
<br />Common Council of Eugene in 1938, calling the Council's attention to the fact
<br />that the Ordinances in question had been invalidated by court action and should
<br />be removed from the record of ordinances.
<br />
<br />It was moved by Bailey, seconded by Davis that the ordinances 8534 and 8536
<br />of the City of Eugene be repealed. Motion carried.
