<br />Third: It is the opinion of the Common Council that the City of Eugene should
<br />1_- absorb into its park system, and take sole responsibility for the repair and main-
<br />tenance of the millrace, if and when title to all lands needed for right-of-way ~
<br />. for the millrace are conveyed, without cost, to the city, and all lands extending ,~......
<br />I; the entire length of the millrace necessary to give full public access to the
<br />facilities of the millrace are dedicated to the public for park purposes.
<br />
<br />Fourth: If only limited access to the facilities of the millrace are provided "
<br />for the public, it is the opinion of the Common Council that the City should share ",
<br />in the expense of repair and maintenance to the extent that the area of banks of the
<br />I millrace open to public use and enjoyment are proportionate to the area of the land
<br />immediately contiguous to its banks.

<br />. Fifth: If owners of millrace properties choose to retain full privacy to all
<br />properties abutting on the millrace, it is the opinion of the Common Council that
<br />repairs and maintenance should be at the expense of such property holders and such
<br />others as may wish to contribute voluntarily to the project, but that, if desired,
<br />the City should make available its organization and equipment to carry out the work
<br />for which finances are supplied."

<br />It was moved by Crumbaker, seconded by Hawn that the resolution be adopted. Motion
<br />carried.
<br />
<br />The City Manager reported that Mayor Earl McNutt had appointed Councilmen Hawn,
<br />Bailey and Pennington and City Attorney, East, as the members of the special com-
<br />mittee to meet with the millrace property owners association group with reference
<br />to plans for the restoration and future maintenance of the millrace.

<br />40 A Resolution - He: Transfer of monies, was submitted and read as follows:
<br />
<br />"VlliEREAS, the 1947 Budget Committee has recommended and ordered the transfer
<br />of the hereinafter mentioned funds, and it appearing to be for the best interests
<br />of the City of Eugene,
<br />
<br />BE IT, THEREFOBE, EESOLVED, by the Common Council of the City of Eugene that
<br />I the swn of ~~S7,9S3.50, now in investments and held by the "Old Improvement Bond
<br />Sinking Fund", be and the same is hereby transferred as follows:
<br />
<br />1. Unto Sewage Disposal Fund, the swn of ~?67, 9S3. 50
<br />
<br />2. Unto Special City Hall Fund, the swn of $20,000.00
<br />
<br />and that cash in the amount of investments so transferred, be and the same is hereby
<br />transferred from said Sewage Disposal Fund and Special City Hall Fund to the Old
<br />Improvement Bond Sinking Fund."

<br />It was moved by Johnson, seconded by Crumbaker that the resolution be adopted.
