<br />"WHEREAS, the Common Council, by Resolution adopted on April 28, 1941 afforded ~
<br />city fire fighting equipment and services to industrial plants adjacent to but ~
<br />outside of the corporate limits of said Ci ty upon certain conditions and payments I
<br />therein provided for; and,
<br />WHEREAS, there are other types of property that desire such protection. and
<br />service.
<br />. NOW, THEREFOF.E, BE IT RESOLVED, by the Common Council of the City of Eugene,
<br />that the owners of any residential or. agricultural properties adjacent to but '
<br />outside of the City limits of the City of Eugene, will be entitled, during any
<br />fiscal year of the City, to one service by the Eugene Fire Department not to
<br />exceed five (5) hours, upon the condition and provided that such owners shall have
<br />firs t paid the sum:..of $100.00 unto the City. In the event the first call exceeds
<br />5 hours of service there shall be paid to the City of Eugene $20.00 per hour or
<br />fraction thereof per piece of equipment. :

<br />Additional payment to the City for all calls in excess of one shall be paid at
<br />the rate of $20.00 p~r hour or fraction thereof per piece of equipment.

<br />The aforesaid annual sum of $100.00 shall be for the fiseal.year of the City, I
<br />or any portion thereof, and any unused portion of such sum shall revert to th.e City
<br />upon the close of the fiscal year. r

<br />Provided, however, that the protection afforded as. above provided and con-'
<br />templated in this Resolution, shall be secondaFY and subsequent to the City's ':
<br />own need and that the City shall have the first use itself of its fire department t

<br />ure to answer calls or because of unsatisfactory or insufficient service or for any I.

<br />43 proposal to hold two regular meetirigs of the C0mmonCouncil per month be taken from;
<br />the table for consideration. Motion carried. i

<br />A motion on the proposal resulted in the following votes: AYE - Davis, Crumbaker, I,
<br />Bailey, Johnson; NO - Hawn, Allen, Pennington and Wells. It being a tie vote, the ~
<br />Mayor cast his vote in favor of the motion which was declared carried. I

<br />The matter of the operation of a general contracting business by the Beebe :'
<br />Construction Co., at Third and Taylor'Streets; in violation of the City zoning ~
<br />44 ordinanc~ was introduced from the f~oor. The City M~nager reporte~ that he had i: I
<br />been advlsed by the Beebe Constructlon Compsny that lt was purchas1ng a new lo~ ~
<br />cation outside the Ci tyLimi ts and that he had been advised by the company that it !.
<br />was attempting to make arrangements for removal to this new site. r f' r

<br />It was moved by Crumbaker, seconded by Allen that the Iv1anager be instructed. to give ,.
<br />notice to the Beebe Construction Company to cease :business operations on the property
<br />in question wit'hin a reasonable time. I:

<br />The matter of an offer from the Very Little Theatre to purchase city ovmed !:
<br />45 Lots No. 1,2,3,4,5 and 6, BlOCk 32, Driverton Addition 'for $3,000.00 with the City I; I.
<br />reserving the right to re-purchase the property in the same amount in event that 1:
<br />the property should not be used for construction and maintenance of a community t ,

<br />The Finance Committee reported that it had considered the offers end ~~9ommended~their
<br />acceptance. Upon motion duly made, seconded and carried, the recommendation of the '
<br />Finance Committee was adopted and sale of the lots authorized. I
