Motion carried. <br /> A report of the Public Safety Committee re: popcorn and concessiong stand in <br /> 5 Business District, was submitted and read as follows: <br /> "The Public Safety Committee of the Council has reported to the Board of <br /> I Appeals in the matter of a confectionary concession on West lOth Avenue in the <br /> rear of Seymour's Cafe. <br /> It was recommended that the petitioner, Mr. Ali Sivrioglu be permitted to <br /> operate this mobile unit on a year to year permit, any renewal shall be subject to <br /> the approval of the City Manager." <br /> It was moved by Pennington, seconded by Allen that the report be received and <br /> placed on file and that the recommendations contained therein be approved. Motion <br /> carried. <br /> A report of the Finance Committee re: Amazon Project, additional fire defenses <br /> 6 and park and recreational facilities, was submitted and read as follows: <br /> "Your Committee on Finance to whom was referred the report of the City Manager <br /> with reference to a financing program for the Amazon Channel Improvement, additional <br /> fire defenses and park and recreational facilities, begs to report as follows: <br /> That we have examined reports of the Finance Department with reference to <br /> present and projected millage rates for City purposes and find that special levies <br /> for sewers and City Hall construction, totaling 6 mills, will expire with the <br /> fiscal year 1949-50 and that it would be possible to finance the bond or levy the <br /> improvement proposals as set forth without seriously effecting the over-all tax <br /> millage rate for the City of Eugene. We, therefore, recommend that the office of <br /> the City Attorney be instructed to prepare three separate ballot proposals governing <br /> I the improvement projects, these proposals to be processed by the appropriate com- <br /> mittee of the Council before being processed with recommendations for formal <br /> acceptance or rejection by the Council." <br /> It was moved by Johnson, seconded by Bailey that the report be received and placed <br /> on file and that the recommendations contained therein be approved. Motion carried. <br /> A report of the Finance Committee re: Property offer and auditors report, was <br /> ? submitted and read as follows: <br /> "Your Committee on Finance to whom was referred various matters, begs to re- <br /> port as follows: <br /> That in the matter of an offer of Paul W. Campbell for a metes and bounds <br /> tract lying east of Block 6, Fairhaven Heights,Addition plus Lot 10, Block 6 in <br /> the sum of $4500.00 be rejected and that a counter offer of $6500.00 be made sub- <br /> ject to refusal from Mr. Clayton Lewis, Herbert A. Sain, and L. G. McInroe, all of <br /> whom had previously filed options for purchase of portions of this tract. <br /> The Committee further reports that it has examined the annual audit of the <br /> City's finances and recommends the acceptance of the auditors report, including <br /> proposal for an audit for the fiscal year ending June 30, 1948." <br /> It was moved by Johnson, seconded by Bailey that the report be received and placed <br /> on file and that the recommendations contained therein be approved. Motion carried. <br /> I REPORTS OF BOARDS AND COMMISSIONS <br /> 8 A report of the Boaxd of Appeals was submitted and read as follows: <br /> "A meeting of the Board of Appeals was held in the office of the Building <br /> Department October 24, 194?, at 5 P.M. Present were Mr. Martin, Mr. Beardsworth <br /> and City Attorney, Mr. Ea st. <br /> I The following petitions were considered and recommendations made: <br /> The petition of Mrs. Ward, 252? Agate Street for waiver of set-back for a <br /> garage was again discussed, the questions being whether or not a non-conforming <br /> garage could be altered and repaired and still remain within the meaning or intent <br /> of the zoning ordinance. <br /> The petition states that, had it not been legal to make the changes and repairs <br /> the old structure would have remained in its existing location and would still be <br /> non-conforming as to set-back which is nine feet from property line. Therefore, <br /> since all work was upon the existing foundations and the street on which the garage <br /> faces (25th Avenue between Columbia and Agate) being a dead-end street at both ends, <br /> with visibility not impaired by the structure, it was decided to permit Mrs. Ward <br /> __ _'.__0 -,-~.
