A communication from Sidney Milligan re: 7-foot deed East 24th Street, was
submi tted and read. '

"On August 15, 1947 R. R. Fenn and Marian D. Fenn, his wife, deeded certain
property particularly described hereafter to Louis M. Swanson arid Bern-ice' 'M.
Swanson. This property which is on the South side of 24th Street between Alder
and Hilyard Streets was conveyed._ to Mr. Swanson and wife .for record purposes only
being in reality the property of Milligan & Sons for the purpose of constructing
residences thereon; Mr. Swanson is a partner in this organization.

At the time the City of Eugene. ,conveyed this pr.operty to R. R. Fenn and wife,:
it retained the North 7 feet of the pr.operty so conveye~, . which strip is iniInedi-
a.tely: South of 24th Street. This- was, retained by the. City. which, so I am advised
retained same since it was then contemplating widening 24th Street to include an
additional 7 foot strip:on each side thereof. I am now advised that the present
plans do not include the additional width on 24th Street at this point and that i
it would..be in order to. transfer the. property back. to the. abutting proper,ty owners .1:

It is therefore requested that the Common Council.author.ize .the City
and. such other. .officials.as may be necessary to execute and. deliver a deed
veying the following deseribed property to Louis M. Swanson and Bernice M.
his wife, since..they, are the abutting owners . of. the. prop.erty. in question:

Manager:
con-
Swanson,f

,

Beginning at a point on the West line"of Alder.Stxeet in the City of
Eugene at its intersection with the South...line ,of. 24;th,..Avenue East
and running thence South seven (7) feet, thence West along a line
parallel with the South city limits 160 feet, thence North.:..-par~llel
with,. the. West line of Alder Street seven (7 ) feet, thence East along
the South.line of 24th Street 160 feet to the point of beginning, all
in 'Eugene., Lane County, Oregon.. :. <

It would, of course, be satiSfactory with us that this be in the form of a
Qui tcla im Beeg in ~ order that.. the City incur no addi.tional expense in transferring
tile and in this connection, I have prepared and. am enclosing herewith a Q.uit-
claim,Deed for your use. in the event you see fit to approve the request herein.
Should any expense wha~soever be necessary for this transfer, I will gladly pay
same upon request. For your further infqrmation, I am attachingheretb the
Warranty Deed from R. R. Fenn and Marian D. Fenn to Louis M. Swanson and Bernice
M. Swanson.to confirm the statements made heretofore.

The acquisition of this 7 foot strip has become- vital to our development of
the property, since. we have, just learned that the. lots in .which.the property was
divided are just under the minim~ required for F.H.A. loan approval. The
additional 7 feet which was retained by the City and is particularly described
above, will make the lots more than sufficient for this approval."
