rr18

e

THAT 47 FEET 'OF THE 50 FOOT SETBACK LINE REQUIRED FOR CHURCHES BE WAIVED WHICH
WOULD LEAVE THE REQUIRED THREE FOOT SETBACK AT THE WEST SIDE OF THEIR PROPERTY LINE.
IN GRANTING:THIS VARIANCE, THE CHURCH WOULD BE ALLOWED TO PLACE THEIR BUILDINGS WITH-
IN THREE FEET OF THE SIDE PROPERTY LINES, THE SAME AS ANY OTHER BUILDING IN THE R-4
MULTIPLE FAMILY DISTRICT AS STIPULATED UNDER SECTION 9, PARAGRAPH F-2.

IT WAS ~OTED~T~AT:THE PROPOSED BUILDING IS TO BE 'WELL SET:BACK FROM 13TH AVBNUE
ON:THE FRONT 'AND IT WAS RELT THAT IF~THE WEST SIDE OF. THE BUILDING WERE LOCATE'D THREE
FEET INSIDE OF THE :PRO~ERTY LINE THAT NO DAMAGE WOULD BE DONE TO ADJACtNT:PRORERTY.

2. THE REQUEST OF ST. MARY'S CATHOLIC PARISH FOR THE VACATION OF THE ALLEY RUNNING
EAST AND WEST BETWEE~ 10TH AND 11TH AVENUE AND EXTENDING FROM CHARNEL TON STREET TO
LINCOLN STREET WAS REVIEWED. THIS ENTIRE BLOCK IS OCCUPIED BY ST. MARY'S SCHOOL ~ND
THE USE OF THE ALLEY RESTRICTED ENTIRELY TO PRESENT OPERATIONS OF THE SCHOOL. IT
WAS FELT THAT THE VACATION OF THIS ALLEY COULD BE GRANTED ONLY IF PROPER PROVISIONS
. . # . . .. ...
WERE MADE FOR FUTURE INSTALLATION AND MAINTENANCE OF ALL UTILITIES WHICH MIGHT
NECESSITATE A CONCRETE TUNNEL UNDERNEATH ANY CONSTRUCTI'ON EXTENDING OVER T~E ALLEY.
THIS TUNNEt :WOULD BE~LARGE ENOUGH FOR THE MAINTENANCE OF ALL UTILITIES AT ALL TIMES,
EVEN TO THE EXTENT OF HOUSING ELECTRICAL TRANSFORMERS IF NEEDED. THERE IS AT PRESENT
AN 8-INC~ SEWER ,RUNNING FROM THE ~ENTER OF THIS BLOCK WEST TO LINCOLN STREET WHIOH
SERVES THE 'SCHOOL BUT ,DOES NOT GO CLEAR THROUGH THE BLOCK. I TIS 'SUGGESTED THAT
BEFORE THPS ALLEY IS ACTUALLY VACATED THAT BUILDING RLANS BE SUBMITTED SHOWING HOW
THESE UT Il n I ES WI LL BE LOCATED '.AND 'MA I NTA I NED FOR THE FUTURE. .

3. THE -REQUEST OF PROPERTY.OWNERS IN THE VICrNITY OF 27TH AVENUE EAST AND AGATE
STREET TO REZONE THE FOUR CORNER LOTS AT THIS INTERSECTION FOR SINGLE FAMILY UNITS
ONLY WAS STUDIED.' IT WAS BROUGHT OUT THAT THE COUNCIL DID NOT HAVE THE AUTHORITY
TO DrSCRIMINATE ZONING REQUIREMENTS IBETWEEN AR~AS WHERE NO PUBLIC PURPOSE WOU~D BE
ACHIEVED. I'T:WAS SUGGESTED.THAT .THEIR OBJECTIVES COU'LD BE .ACCOMPLISHED THROUGH DEED
RESTRICTIONS RATHER THAN AN ENDEAVOR TO_REZONE THESE FOUR CORNER LOTS.

4. MEMBERS OF THECOMMITTE~ MET WITH MEMBERS OF THE EUGENE WATER & ELECTRIC BOARD
.I:N CONNECTION WIT~THE CITY OF EUGENE RELEASING TO THE SOUTHERN PACIFIC COMPANY ITS
RIGHT, TITLE AND INTEREST IN THE GRADE CROSSING NEAR 5TH AND MILL STREETS JUST EAST
OF :THE NEW OVERHEAD.CROSSING. IT WAS .RECOMMENDED BY THOSE PRESENT THAT THIS CROSSING
BE MAINTAINED TO SERVE THE I.NDUSTRIAL-SE,CTION ON THE NORTH SIDE OF THE TRACKS NOT NOW
ACCESSI BLE FROM THE FERRY STREET OVERPASS AND THAT THE SOUTHERN PACI FI.C INSTALL ADE-
QUAITE SIGNALS TO SAFEGUARD THIS CROSSING."

IT WAS MOVED :BY CRUMBAKER, S[CONDED BY BOOTH ~HAT THe REPORT OF ~HE PUBLIC WORKS
COMMI TTEE BE AD:OPTED..
