CnLLETT WAS SUBMITTED AND <br />READ AS FOLLOWS: <br /> <br />"THE REGULAR MEETING Or THE BOARD OF ApPEALS WAS HELD AT THE CITY HALL, JANUARY 5, <br />1955 TO CONSIDER THE FOLLOWING REQUEST rOR VARIANCE. MEMBERS PRESENT: MR. GILLILAN, <br />MR. VAALAR, MR. MORRIS, MR. MOYER, AND MR. BALZHISER. <br /> <br />MR. A. C. COLLETT WHO OWNS THE PROPERTY AT 1492 WEST 6TH AVENUE ,_ BE I NG THE SOUTH <br />EAST CORNER Or 6TH AVENUE AND ALMADEN STREET; PROPOSES TO CONSTRUCT A BUILDING APPROXI- <br />MATELY 66 FEET BY 107 FEET IN DIMENSION ON THE CORNER. THIS PROPERTY IS IN THE M-I <br />LIMITED INDUSTRIAL ZONE AND THE SIDE STREET SETBACK REQUIREMENT IS TEN rEET~ FRONTAGE <br />SETBACK IS SEVEN FEET. <br /> <br />MR. COLLETT HAS REQUESTED A WAIVER Or SIX'FEET OF THE TEN FEET IN ORDER TO HAVE <br />THE DESIRED FLOOR SPACE A~D MAINTAIN A 28 rOOT SETBACK FROM 6TH AVENUE FOR PARKING <br />PURPOSES. <br /> <br />e <br /> <br />THE BOARD IN ITS DELIBERATION TOOK INTO CONSIDERATION THE INDUSTRIAL ZONING Or THE <br />AREA AND THE ECONOMIC VALUE TO THE OWNER BY NOT REQUIRING THE STRUCTURE TO BE REDUCED <br />IN AREA, AND FURTHER, THE SETBACK WOULD CONFORM TO A SETBACK PRECEDENT ESTABL1SHED IN <br />THE PAST BY GRANTING A SIMILAR REQUEST IN THE BLOCK ABOUT THREE YEARS AGO. UPON THE <br />FOREGOING BASIS THE REQUEST WAS GRANTED. <br /> <br />FOLLOWING THE BUSINESS AT HAND A NEW CHAIRMAN OF THE BOARD WAS ELECTED TO SUCCEED <br />MR. LUVAAS WHO WAS REPLACED BY MR. MOYER. KOPPE, SECONDED BY MR. BOOTH THAT THE REPORT OF THE BOARD OF ApPEALS <br />BE ADOPTED. MOTION CARRIED. <br /> <br />13 <br /> <br />I T' WAS ANNOUNCED BY THE MAYOR THAT THE' PUBLI C 'WORKS COMMITTEE AND OTHER C.OUNC I LME'N <br />MET WITH THE EUGENE WATER & ELECTRIC BOARD DURING THE WEEK TO DISCUSS PROPOSED LEGISLATION <br />WHICH WOULD IMPOSE SOME FORM OF TAXATION UPON THE EUGENE WATER & ELECTRIC BOARD. HE INDICATED <br />THAT ONE OR TWO TAX BILLS ARE SCHEDULED TO BE PRESENTED TO THE STATE LEGISLATURE BY CERTAIN <br />INTERESTS. THE CITY ATTORNEY NOTED THAT ONE OF THE-PROPOSED BILLS WAS FOR AN AD VALOREM TAX <br />AND ANOTHER WAS A TAX BASED ON GROSS RECEIPTS OF THE EUGENE WATER & ELECTRIC BOARD. HE <br />INDICATED THAT THE QUESTION BEFORE THE COUNCIL IS WHAT ACTION, IF ANY, SHnULD THE COUNCIL <br />TAKE WITH RESPECT TO SUCH PROPOSED LEGISLATION. <br /> <br />';:... <br />. <br /> <br />IT WAS MOVE~ BY MR. BOOTH, SECONDED BY MR. KOP~E THAT THE CITY MANAGER AND CITY ATTORNEY <br />BE AUTH'ORI ZED TO COLLABORATE WI TH THE ATTORNEY OF THE EUGENE WATER & ELECTRI C BOARD ON A <br />DRAFT OF AN ANSWER TO THE QUESTION FOR COUNCIL CONSIDERATION.- <br /> <br />14 <br /> <br />A PERMANENT REPORT Or THE-PLANNING COMMISSION - REZONING -FIRST CONGREGATIONAL CHURCH; <br />VARIANCE FOR JOHN-H. HOUSER; REZONING, LOYAL ORDER OF MOOSE, RAY D.
