THE ORDINANCE HAS <br />RECEIVED~ONSIDERATION BY A COUNCIL COMMITTEE UPON SEVERAL OCCASIONS AND IN THE <br />COURSE Of THAT CONSIDERATION A QUESTION AROSE AS TO THE ACTUAL NUMBER AND TYPE OF <br />SERVICE STATION OPERATORS WHO fAVORED IT. THE UNANIMITY <br />OF OPINION REFLECTED BY THE PETITIONS AfFIRMS THE POSITION THAT THE'ASSOCIATION <br />HAS TAKEN REGARDING THE NECESSITY FOR THE ORDINANCE. OUR POSITION HAS BEEN, AND <br />STILL REMAINS, THAT THE BENEFICIAL EFfECTS OF THIS ORDINANCE WOULD JUSTIFY ITS <br />PASSAGE. THE LEGAL QUESTION 'INVOLVED is ONE THAT CAN ONLY BE DETERMiNED BY A <br />COURT Of COMPETENT JURISDICTION AND DECISIONS FROM OTHER JURISDICTIONS INDICATE <br />A SPLIT OF AUTHORITY. THIS FACT, HOWEVER, HAS NOT. DETERRED THE CITY FROM ADOPTING <br />OTHER ORDINANCES THAT HAVE BEEN SUBJECT TO THE SAME LACK OF OREGON PRECEDENT AND <br />WE fEEL THAT THE PROPOSED ORDINANCE SHOULD BE ACCORDED THE SAME CONSIDERATION. <br />DESPITE THE WIDE PUBLICITY RECEIVED BY THE INTRODUCTION OF THE ORDINANCE THERE HAS <br />BEEN, SO FAR AS WE ARE AWARE, NO OPPOSITION TO IT.
