THE ORDER WAS ISSUED IN COM- <br />PLIANCE WITH THE PROVISIONS OF ORS 760.050. <br /> <br />TWENTY-SEVEN INCORPORATED CITIES HAVING A POPULATION OF LESS THAN 100,000 AND VARIOUS <br />RAILROAD OFFICIALS AND OTHER PARTIES HAVING AN INTEREST IN THE MATTER WERE GIVEN STATUTORY <br />NOTl CE AS TO TI ME ,AND PLACE OF HEAR I NG. <br /> <br />e <br /> <br />THE HEARING CONVENED, EVIDENCE WAS ADDUCED ON BEHALF OF PARTIES AS SET FORTH_ABOVE, THE <br />HEARING WAS COMPLETED AND THE MATTER SUBMITTED FOR DETERMINATION. BASED UPON SAID EVIDENCE <br />AND RECORD, ,IT IS FOUND THAT: <br /> <br />TRAIN SPEEDS THROUGH THE VARIOUS CITIES ARE GOVERNED BY TIMETABLES OF THE OPERATING <br />RAILROADS, AND WERE ESTABLISHED BY-FRANCHISE kGREEMENTS BETWEEN THE CITIES AND RAILROAD <br />COMPANIES_OR BY ARBITRARY RULINGS'~F THE RAILROAD COM~ANIES.' MANY OF THE SPEEDS REGULATED <br />BY '~RANCHISES WERE PLACED IN EFFECT DURING THE DAYS OF PASSENGER TRAIN OPERATION AND CON- <br />SEQUENTLY ARE NOT SUITABLE FOR PRESENT DAY TRAFFIC CONDITIONS. No PASSENGER TRAIN SERVICE <br />IS NOW PROVIDED ON THE SPOKANE, PORTLAND & SEATTLE SYSTEM LINES THROUGH THE CITIES INVOLVED <br />IN THIS PROCEEDINGS. <br /> <br />I <br /> <br />FREIGHT TRAINS ARE NOT SCHEDULED A~D TERMINAL LEAVING AND ARRIVING TIMES ARE NOT PUB- <br />LI SHED OR PREDETERMI NED WI TH AN'( EXACTNESS~ CONSEQUENTLY, ANY CHANGES THAT MI:GHT .BE MADE <br />BY INCREASING OR DECREASING TRAIN SPEEDS THROUGH THE INCORPORATED CITIES WOULD HAVE NO <br />APPRECIABLE EFFECT ON-RAILROAD OPERATIONS. <br /> <br />STUDY OF THE .CROSSINGS INVOLVED DID NOT INDICATE THAT TRAIN SPEEDS,WERE EXCESSIVE OR <br />THAT THE ACCIDENT FREQUENCY WAS BEING ADVERSELY AFFECTED BY EXCESSIVE TRAIN SPEEDS. ON THE <br />CONTRARY IT WAS FOUND THAT AT SOME LOCATIONS, ~ERMISSIBLE SPEEDS WERE SO SLOW AS TO,CAUSE <br />TRAFFIC CONGESTION AND IRRITATING:VEHICLE DELAYS AT THE CROSSINGS. WITH NO CORRESPONDING <br />INCREMENT IN SAFETY.OF RAIL AND VEHICLE OPERATIONS. <br /> <br />FROM.
