THE COMMITTEE REPRE- <br />SENTATIVES VIEWED THE AREA AND SOME DISCUSSION WAS H~LD ON THE POSSIBI'LITY OF <br />VACATING CHESHIRE STREET FOR. USE BY TH~ SCHOOL DISTRICT AS ~ONG AS IT MAIN- <br />TAINS A SCHOOL AT THIS LOCATION WITH TH~ FURTHER PROVISION THAT WHEN THE <br />SCHOOL DISTRICT C~ASES,TO USE. THIS AREA AS A SCHOOL, THE STREET RIGHT-OF-WAY <br />WOULD REVERT TO THE_CITY. IT WAS SUGG~STED THAT THE SCHOOL DISTRICT'S <br />ATTORNEY DEVELOP. A CONTRACT OR AGREEMENT ADONG THESE LINES. No FORMAL ACTION <br />WAS TAKEN ON THE REQUEST. <br /> <br />3/23/59 <br /> <br />IT WAS MOVED BY MR. SHEARER SECONDED BY MR. MCGAFFEY THAT ITEM 3 OF THE REPORT OF THE COM- <br />MITTEE BE APPROVED. MOTION CARRIED. <br /> <br />4. REPORT CONCERNING ACCIDENT IN THE OLD QUARRY AT SKINNERS BUTTE PARK AND RE- <br />QUEST FOR FENCING - A REPORT WAS MADE BY THE SUPERINTENDENT OF PARKS & <br />RECREATION CONCERNING AN ACCIDENT WHICH OCCUR~ED AT SKINNERS BUTTE PARK AT <br />APPROXIMATELY 3:30 PM, FEBRUARY 28, 1959. IN THE REPORT IT WAS STATED THAT <br />TWO BOYS; NAMELY, BILLY HART OF 39 NORTH CEDAR STREET AND JIMMIE LAKE OF <br />150 NORTH JACKSON STREET, HAD RECEIVED PERMISSION FROM THEIR PARENTS TO PLAY <br />IN SKINNERS BUTTE PARK. WHILE PLAYING THEY CLIMBED DOWN THE WEST SLOPE OF <br />. , <br />THE PARK ABOVE THE OLD. ROCK QUARRY, LOST THE I R F"OOT I NG AND FELL ,I NTO THE <br />QUARRY. BILLY HART RECEIVED SERIOUS INJURY TO HIS LEFT ARM IN THAT BOTH <br />BONES WERE BROKEN ABOVE THE WRIST, AND ~IS RIGHT THIGH WAS BROKEN PLUS OTHER <br />BRUISES. JIMMIE LAKE RECEIVED ONLY SLIGHT BRUISES AND SKIN BURNS. AT THE <br />TIME THE ACCIDENT HAPPENED TO, THE H~RT BOY, HE WAS ASSISTED BY PEOPLE IN THE <br />AREA AND TAKEN TO THE HOSPITAL. <br /> <br />THE PARKS & RECREATION SUPE~INTENDENT INDICATED HE HAD REVIEWED THE ACCIDENT <br />SITUATION WI,TH JIMMIE LAKE, AND IT APPEARED THAT. THE T.WO BOYS ,WERE COMING <br />DOWN THE WEST SLOPE ABOVE THE QUARRY WHEN THEY CLIMBED INTO A SLIDE AREA AND <br />THAT APPARENTLY BILLY HART SLIPPEP AND FELL AT WHICH TIME, THE LAKE BOY HEARD <br />THE HART BOY CRY OUT. AT TKIS POINT THE LAKE BOY FELT HE COU~D NOT GO BACK <br />UP THE SLOPE HE HAD COME DOWN SO HE SLID DOWN ONE OF THE ROCK COLUMNS AND <br />RAN HOME TO NOTIFY HIS PARENTS OF THE ACCIDENT. <br /> <br />PHOTOS OF THE AREA WERE TAKEN AND AN ESTIMATE OF" FENCING WITH 6' CHAIN LINK <br />F'ENCE WHICH IS ESTIMATED TO COST BETWEEN $5000 AND $6000 WAS GIVEN AS WAS <br />AN ESTIMATE ON 5' WOVEN STOCK FENCE WITH TWO STRANDS OF ,BARBED WIRE ABOVE <br />METAL POSTS WHICH WAS ESTIMATED AT $1500. IT WAS F"URTHER STATED THAT ESTI- <br />MATES WERE HARD TQ MAKE SINCE THERE IS NO. MEANS OF GETT~NG VEHICLES TO THE <br />AREA TO CARRY MATERI~LS, AND FURTHER SINCE THE BUTTE IS ALMOST SOLID ROCK <br />IT MIGHT PROVE DIFFICULT TO DIG POST HOLES. <br /> <br />ON QUESTlON THE CITY ATTORNEY INDICATED THAT HE DID NOT BELIEVE THERE IS <br />ANY LIABILITY ON THE PART OF THE CITY, THAT THE POTENTIAL FENCING OF'THIS <br />AREA WOULD BE A MATTER OF POLICY. IT WAS ALSO POINTED OUT THAT FENCING <br />THE AREA MIGHT PRESENT AN ADDED CHALLENGE TO CHILDREN. IT WAS RECOMMENDED <br />THAT THE AREA BE POSTED "No TRESPASSING" OR "DANGEROUS AREA". <br /> <br />IT WAS MOVED BY MR. SHEA~ER SECONDED BY MR. MCGAFFEY THAT ITEM 4 OF THE REPORT OF THE COM- <br />MITTEE BE APPROVED. MOTION CARRIED. <br /> <br />5. REQUEST TO PURCHASE ADDITIONAL RIGHT-OF-WAY FOR CHAMBERS STREET AND FILMORE <br />STREET BETWEEN 23RD AND 24TH AVENUES - IT WA~ STATED THAT THE CITY HAS <br />DEDICAT~D PROPERTY ALONG THE WEST SIDE OF" THE PARK-AIRE SUBDIVISION SO THAT <br />CHAMBERS STREET WOUL.D HAVE AN 80' RIGHT-OF-WAY AND THAT ADDITIONAL PROPERTY <br />IS NEEDED FROM ONE PROPERTY HOLDER BETWEEN 23RD AND 24TH AVENUES TO CARRY <br />THE 80' RIGHT-OF-WAY TO 24TH AVENUE. THE PROPERTY NEEDED IS IN THE OWNER- <br />SHIP OF MR. CHARLES POOLE AND WOULD REQUIRE A DEDICATION OF" THE WEST 30' OF <br />HIS PROPERTY. IT WAS FURTHER STATED THAT !F FILMORE STREET IS TO BE EXTENDED <br />TO 24TH AVENUE A RIGHT-OF"-WAY WOULD ALSO HAVE TO BE OBTAINED FROM MR. POOLE <br />F'OR THE EXTENSION OF' FILMORE STREET. <br /> <br />WITH REFERENCE TO THE ADDITIONAL 30' RIGHT-OF-WAY REQUIRED F'OR CHAMBERS <br />STREET, .MR. POOLE HAS OFF'ERED TO SELL TO THE CITY THIS PORTION OF HIS PRO- <br />PERTY FOR THE SUM OF $600. HE DID NOT STATE ANY PRICE FOR THE RIGHT-OF-WAY <br />FOR FILMORE STREET. THE DIRECTOR OF" PUBLIC WORKS FURTHER INDICATED THAT <br />THE QUESTION OF RIGHT-OF-WAY IS OF IMMEDIATE CONCERN SINCE A SEWER ASSESS- <br />MENT IS BEING COMPUTED IN THIS AREA AND MUST BE TAKEN INTO CONSIDERATION IN <br />THE COMPUTATION OF THE ASSESSMENT. AF'TER SOME DISCUSSION THE COMMITTEE RECOM- <br />MENDED THAT THE RIGHT-OF-WAY F'OR CHAMBERS STREET BE ACQUIRED FROM MR. POOLE <br />AT THE STATED PRICE OF' $600. <br /> <br />IT WAS MOVED BY MR. SHEARER SECONDED BY MR. MCGAFFEY THAT ITEM 5:0F THE REPORT OF THE COM- <br />MITTEE BE APPROVED. ROLLCALL VOTE. ALL COUNCI~MEN PRESENT VOTING AYE, MOTION CARRIED. <br /> <br />6.
