<br />IITHIS LETTER IS WRITTEN TO THE COUNCIL THROUGH YOUR OFFICE (CITY MANAGER) WITH
<br />RESPECT TO THAT CERTAIN LETTER OF JANUARY la, I~60 ADDRESSED TO YOU BY ME ON BEHALF
<br />OF MY CLIENT, FOR THE PURCHASE OF THE LIBRARY PROPERTY.

<br />I AM ADVISED THAT THERE WILL BE A RECOMMENDATION TO THE COUNCIL MADE AT ITS
<br />MEETING, MONDAY, JANUARY 25, 1960, TO REFUSE TO ACCEPT THE BID WHICH WAS MADE IN
<br />THE SUM OF $56,125.00. PLEASE ACCEPT THIS LETTER AS A FORMAL PROTEST TO SAID
<br />RECOMMENDATION AND A REQUEST ON BEHALF OF MY CLIENT THAT. THE RECOMMENDATION BE
<br />REFUSED BY THE COMMON COUNCIL.

<br />IT IS MY PERSONAL FEELING THAT SUCH A PROCEDURE, IF ADOPTED, WOULD BE A VERY
<br />REGRETTABLE PRECEDENT TO BE ESTABLISHED BY THE CITY OF EUGENE, PARTICULARLY IN
<br />LIGHT OF THE PREVIOUS ACTION OF THE COUNCIL DIRECTING ITS ADMINISTRATIVE DEPART-
<br />MENT TO SELL THIS PROPERTY. I FAIL TO FIND ANYTHING IRREGULAR WITH RESPECT TO THE
<br />COUNCIL'S ACTION IN SO DIRECTING ITS SALE, OR IN THE SALE PROCESSES UP TO THIS
<br />POINT. I DO NOT BELIEVE THAT THE BASIS, INSOFAR AS I KNOW THEM AT THIS TIME, FOR
<br />THE RECOMMENDATION OF THE COMMITTEE RESTS UPON SOLID GROUND. IF IT BE TRUE THAT
<br />THE COUNCIL HAS CONSIDERED THE REASONS FOR THE SALE, THEN THOSE REASONS MUST STILL
<br />EXIST. To HOLD THIS PROPERTY FOR THE PURPOSE OF A PARKING LOT, IN MY ESTIMATION
<br />IS UNECONOMIC AND CONTRARY TO A MANDATE OF THE PEOPLE WITH RESPECT TO THE CITY OF
<br />EUGENE ENGAGING IN THE PARKING LOT BUSINESS. -

<br />TAINED NO RESTRICTION WITH RESPECT TO ANY USE TO BE MADE OF THE PROPERTY, NOR DID
<br />IT CONTAIN A MINIMUM BID, OR ANY OTHER REQUIREMENT OF USE. IT DOES NOT SEEM FITTING,
