<br />IN THE AMOUNT OF $16,490 INCURRED BY JOHN KOVTYNOVICH IN THE CONSTRUCTION OF A SEWAGE
<br />PUMPING STATION ON THE EAST BANK OF THE WILLAMETTE RIVER. THE CITY ATTORNEY'S OPINION
<br />WAS THAT THE CLAIM SHOULD BE DENIED. MR. JIM BROWNHILL, ATTORNEY REPRESE~TING MR.Kov-
<br />TYNOVICH, BRIEFLY REVIEWED THE CLAIM, MADE ON THE BASIS OF UNKNOWN SUBSURFACE AND
<br />LATENT PHYSICAL CONDITIONS AND LOSS OF POWER. IT WAS THE FEELING OF BOTH THE CITY
<br />ATTORNEY AND MR. BROWNHILL THAT POSSIBLY THIS MATTER SHOULD BE DETERMINED IN COURT SO
<br />THAT THERE WOULD BE SOME BASIS fOR SETTLEMENT OF ANY FUTURE SIMILAR SITUATIONS.

<br />2. SALVATION ARMY EMERGENCY SHELTER - THE CITY MANAGER READ A STATEMENT PRESENTED BY
<br />MR. RALPH HILLIER, ATTORNEY REPRESENTING SEVERAL PROPERTY OWNERS IN THE VICINITY OF
<br />645 OLIVE STREET, PROPOSED LOCATION OF THE SALVATION ARMY EMERGENCY SHELTER. THE
<br />STATEMENT INDICATED THERE WAS OPPOSITION TO THE LOCATION OF THE EMERGENCY SHELTER
<br />AT THAT LOCATION AND THAT THE BUSINESS PEOPLE IN THE AREA WERE REQUESTING THE COUNCIL
<br />TO HAVE A HEARING ON THE MATTER. CAPTAIN STENVICK OF THE SALVATION ARMY SPOKE RATHER
<br />SHARPLY ON THE NEED FOR THE SHELTER AND ITS ESTABLISHMENT AT 645 OLIVE. THE MAYOR
<br />THEN STATED BOTH SIDES WOULD BE HEARD AT A LATER MEETING OF THE COUNCIL.

<br />MR. SWANSON MOVED SECONDED BY DR. PURDY TO TABLE THE MATTER OF THE SALVATION ARMY EMERGENCY SHEL-
<br />TER. MOTION DEFEATED, 6-2.

<br />CAPTAIN STENVICK STATED HE WISHED TO MAKE ANY REMARKS AFTER THE OPPOSITION HAD BEEN HEARD.

<br />MR. RALPH HILLIER, ATTORNEY REPRESENTING A GROUP OF PROPERTY OWNERS IN THE AREA OF THE PROPOSED
<br />ARMY SHELTER, SPOKE OPPOSING THE ERECTION OF THE PROPOSED SHELTER AND ALSO PRESENTED A PETITION
<br />BEARING APPROXIMATELY 138 NAMES OF PERSONS ALSO OPPOSING THE ESTABLISHMENT OF THE SHELTER AT THAT
<br />LOCATION. THE PETITION CONTAINED NAMES OF OWNERS OF PROPERTY IN THE AREA, PEOPLE OPERATING
<br />BUSINESSES IN THE AREA, AND CUSTOMERS OF THOSE BUSINESSES. MR. FRED MANELA OF WESTERN PACIFIC
<br />WHOLESALE READ A SHORT PREPARED SPEECH OPPOSING THE SITE. ALSO, MR. TOM BLAIR, REPRESENTING THE
<br />HEILIG THEATRE, SPOKE IN OPPOSIT~ON.

<br />THE CITY MANAGER READ A LETTER TO THE COUNCIL FROM MRS. MITCHELL STEFFENSEN, MRS. CHAS. SCHULL,
<br />MRS. SYLVIA LA MARCHE AND MRS. EDWARD ARMSTRONG STATING THEY WOULD LIKE TO SEE THE SHELTER ES-
<br />TABLISHED AT THE PROPOSED LOCATION. MR. ROBB SEUSS, HOME BUILDER AND APARTMENT HOUSE OWNER,
<br />SPOKE ON BEHALF OF THE ESTABLISHMENT OF THE SHELTER, SAYING THAT IN HIS OPINION THE SALVATION
<br />ARMY WOULD OPERATE A VERY ORDERLY ESTABLISHMENT. CAPTAIN STENVICK THEN SPOKE, ANSWERING SOME
<br />QUESTIONS FROM THE COUNCIL AND MEMBERS OF THE AUDIENCE REGARDING THE PROPOSED OPERATION, THE NUM-
<br />BER OF PEOPLE TO BE SERVED, AND THE TYPE OF ESTABLISHMENT. PROPOSED.
