Sanitary sewer construction Phase V Wi11akenzie <br />Sewers (C-1179. May 28. 1963) - In a written opinion, the City Attorney recommended <br />that the City accept the offer of settlement from the bonding company for Abrams <br />Construction Company on a 95% basis of ,the original claim, which would result in a <br />net amount of $40,405.88. <br /> <br />'e <br /> <br />Mr. Hawk moved seconded by Mr. Crakes to approve settlement on the 95% basis. Rollcall vote. All <br />councilmen present voting aye, motion carried. <br /> <br />2 <br /> <br />2. Planning Commission Report - January 25. 1966 <br />a. Rezone to C-3P SE corne~ 14th and Charne1ton. Scofield - The Planning Commission <br />had recommended denial of Dr. Scofield's request for this rezomng from R-3 <br />Multiple Family Residential. <br /> <br />I <br /> <br />Mr. Hawk moved seconded by Mr. Crakes to deny the requested rezoning. Motion carried. <br /> <br />3 <br /> <br />b. Variance to allow cabinet shop at 1891 Highway 99N. Ward - The Planning Com- <br />mission recommended approval of a variance from the C-3P requirements at this <br />location to permit a cabinet shop. <br /> <br />Mr. Hawk moved seconded by Mr. Crakes to grant the variance. Motion carried. <br /> <br />4 <br /> <br />c. Amend R-4 Requirements - The Planning Commission requested the return of its <br />permanent report of September 3, 1963 recommending certain amendments to R-4 <br />district requirements. <br /> <br />Mr. Hawk moved seconded by Mr. Crakes to return the recommendation. Motion carried. <br /> <br />5 <br /> <br />d. Vacation 61-foot alley north of 14th between Charne1ton and tOlive.., First <br />Methodist Church (Thompson) - The Planning Commission had recommended approval <br />of the requested vacation. <br /> <br />Mr. Hawk moved seconded by Mr. McNutt to proveed with vacation proceedings. Motion carried. <br /> <br />6 <br /> <br />3. Jail Committee Report - Mayor Cone called for discussion of the Jail Committee's <br />report previously distributed to Council members for study. Stanley Parrish sug- <br />gested that the location of the jail could be incompatible with the downtown de- <br />velopment program and that the jail should not be .expanded in its existing loca- <br />tion. Hr also stated that the area should be developed to a higher use. Further <br />discussion followed. <br /> <br />I <br /> <br />Mr. Hawk moved seconded by Mr. Crakes to table the Jail Committee's report. Motion carried. <br /> <br />ORDINANCES <br /> <br />7 <br /> <br />Council Bill No. 7295 - Levying assessments for construction of sanitary sewer on Spring Boulevard <br />from 27th Avenue to south City limits; and on 27th Avenue from Woodlawn to Spring Bourevard, submitted <br />and read the first time in full on November 22, 1965 and held over for proper notice of assessment to <br />be given owners of affected property~ brought back for second reading on December 13, 196 and held <br />pending annexation of contiguous properties. <br /> <br />e <br /> <br />It is now recommended the council bill and the original assessment be destroyed and a new assessment <br />ordinance brought back at a later date. <br /> <br />Mr. Hawk moved seconded by Mrs. Lauris that the council bill be destroyed. Motion carried. <br /> <br />8 <br /> <br />Council Bill No. 7334 - Levying assessments for paving and sanitary sewers in area within Rep1at <br />of Lots 6 and 7, Block 6, Sunny Hollow Addition, submitted and read the first time in full on January <br />24, 1966 and held over for proper notice of assessment to be given owners of affected property, is now <br />brought back for consideration with no written protests on file. <br /> <br />I <br /> <br />Mr. Hawk moved seconded by Mrs. Lauris that the bill be read the second time by council bill number <br />only, with unanimous consent of the Council. Motion carried unanimoys1y and the bill was read the <br />second time by council hi. 11 number only. <br /> <br />Mr. Hawk moved seconded by Mrs. Lauris that the bill be read the third .time by council bill number <br />only" with unanimous consent of the Council. Motion carr.ied unanimously and the bill was read the <br />third time by council bill number only. <br /> <br />e <br /> <br />Mr. Hawk moved seconded by Mrs. Lauris that the bill be approved and, given final passage. Rollcall <br />vote. All councilmen present voting aye, the bill was declared passed and numbered 14164. <br /> <br />2/14/ 66 - 9 II..... <br />
