J&T Construction. 3871 Royal - Councilman Lassen asked if a report ~as made regard~ . <br />ing the use of a helicopter at this location and the expanded use of the property for <br />heavy equipment storage. He was informed the use of a helicopter is not in violation <br />of any laws except perhaps the zoning ordinance, and that the City Attorney will tour' <br />. the area soon and make a decision with regard to the complaint about expanded use of <br />the property. <br /> <br />2 <br /> <br />2. Street'Conditions. Bethe1-Danebo - Councilman Lassen also asked if anything was re- <br />ported with regard to complaints about manholes in the Bethe1-Danebo area. The Pub- <br />lic Works Director explained the manholes were left higher than'the street surface <br />to allow'for street surfacing"wh:tch'is not accomp1ished:until "about a year'after com- <br />pletion of a sewer project to allow for proper settling and resurfacing. <br /> <br />.'. <br /> <br />e <br /> <br />3 <br /> <br />3. Public Works Pro;ects Pamphlet -'Counci1woman'Hayward inquired regarding revisio~ of <br />the pamphlet which explains procedures followed by the pubiic'Works~ Department in <br />construction of street, alley, sewer, and: sidewalk projects. She was informed there <br />has been some preliminary discussion at the' staff level.'. Councilman Purdy suggested <br />a temporary program"be instituted to inform property owners about estimated costs <br />and method of computing assessments prior to start of construction. . -. <br /> <br />I <br /> <br />Mrs. Lauris moved seconded by Mr. McNutt 'that- Items 1, 2,': and 3 of~'the committee report be received <br />and filed. . Motion carried." <br /> <br />4 <br /> <br />4. Housing Policy Statement. EDA - A ho~sing policy statement ,adopted by the Eugene nevelop- <br />men~ Agency was referred to the Council for consideration ana possible adoption. It <br />provides for consideration of the social and economic effects of removal of any 10w- <br />or middle-cost housing in connection with public projects. Mr. McNutt moved seoonded <br />by Dr. Purdy to endorse the EDA housing policy statement. Motion carried. <br />!. .: <br /> <br />Mrs. Lauris moved seconded by Mr. McNutt to approve Item 4 of the Committee report. Motion carried. <br /> <br />5 <br /> <br />5. 10th and Oak Parking Assessment District - As a result of objections filed by Stanley <br />Darling, attorney representing the DeNeffe Estate, to exemptionof'certain"properties <br />within'the proposed 10th and Oak parking assessment district, and after review of the <br />exempted properties cited in Mr. Darling's objections, it was suggested there was <br />justification for assessment of two parcels belonging to Eugene Medical Center, , <br />Parcel 33 - $34,540.33 and 54% of Parcel 42 ~ $49,738.07. It was"fe1t these two prop-' <br />erties are not used for public parking since they are reserved for use of the Medical <br />Center. Levying these two assessments would change assessment against other benefited <br />properties in the district an estimated 5%. <br /> <br />Sidney Thwing, attorney representfng the Eugene Medical Center', stated the Medical' <br />Center operates the "several exempted parcels as one public parking facility for revenue, <br />which would be in direct competition with the proposed facility at 10th and Oak. He <br />said'77 of the parking spaces are leased to doctors on a monthly payment basis, and <br />the balance of 238 are open to the public. He also pointed out that had the Medical <br />Center been advised at the time of petitioning the assessment district that these <br />parcels would be assessed, there is serious doubt that the Medical Center would have' <br />joined in the petition.: Dr. L. A. White, also representing the Medical Center, pro- <br />tested changing the assessments originally levied. Discussion brought out:the point <br />that the matter o~ "exempt" or "non':'exempt" properties will be settled in court since <br />there are two suits'now pending. <br /> <br />I <br /> <br />e <br /> <br />Mrs. "Lauris moved seconded by Mr. Anderson to proceed with assessments as originally <br />initiated, which exempts the Eugene Medical Center parking facilities. Motion carried. <br />. ',1' . ; . .:... -- <br /> <br />Stanley Darling, representing Sylvanus' Smith, owner of' property at the northwest corner of 10th and <br />Oak on which part of the proposed parking facility is to be constructed, asked that a letter from <br />Mr. Smith addressed and delivered to the City Manager earlier in the day be read into the record. <br />The letter was not read' because of possible effect on values of properties mentioned therein, but a <br />resume of the letter was given indicating Mr. Smith's opposition to the City's acquiring his prop- <br />erty for a site for the off-street.parkU~g structure unless it is acquired. on his terms. These are <br />that the City acquire one of two sites' Mr. Smith' designated, and bonscrucE;thereon ..a, building with <br />~ ,.' . \ 0.. <br />7500 square feet of space, all a~ ~ity'expense, 'and that.thi$ property not be assessed for the park- <br />ing structure.: The letter also expressed oppos'ition to formation of .'the' parking assessment district. <br /> <br />Robert Moulton, attorney representing First Nationa1'Bank of'Oregon as trustee for the Fred Fisk <br />estate, requested permission to present affidavits on behalf of his client for consideration at a <br />future committee meeting.
