McNutt, Anderson, Lassen, Hayward, McDonald, and <br />Wingard; City Manager and staff; and others. <br /> <br />1 <br /> <br />l. 10th and Oak Parking Assessment District, Fisk Property - Robert E. Moulton, attorney <br />representing First National Bank as trustee for: the Fred Fisk estate, presented a <br />chart comparing the use of the Fisk property, east of the Montgomery Ward store on <br />11th between ~illamette and Oak, with that of two properties exempted from assessment <br />for the proposed parking facility at lath and Oak. Mr'. Moulton claimed the ratio of <br />assessment to actual value of the Fisk property was excessive, ,and that there was no <br />substantial difference between the' use of the parking portion of this property and <br />other exempted properties, except that it is under a long-term lease whereas the <br />others are under a 30-day lease arrangement. He asked the Council to consider exempt- <br />ing that, portion of the property used for parking, thereby reducing the assessment <br />approximately $80,000. <br /> <br />- <br /> <br />The City Attorney remarked that there is no relevancy so far as the ratio of assess- <br />ment to property value is concerned; that the only consideration should be because <br />of the similarity of the lease and use of the Fisk property to that of the Khox and <br />Etter properties.' Hr further stated'any, legalities would be decided in court because <br />of the suit now pending (DeNeffe properties). Reduction of the Fisk assessment by <br />r about $80,000: (s ':estimated to incr'ease other assessments' in the distri'ct by approxi- <br />mately 4%. <br /> <br />I <br /> <br />Dr. Purdy mov~d seconded by Mr.' McDonaldtb wUhdraw the parking district as'sessment' <br />against that portion of the Fisk property used for parking' lot purposes. Motion <br />carried. <br /> <br />Mrs. Hayward moved seconded by Mr. Lassen to approve Item 1 of':the Committee report.' Rollcall vote. <br />All councilmen present voting aye, motion carried. <br /> <br />Roubert Moulton, attorney representing First National Bank, trustee for the Fisk estate, told the <br />Council that upon passage of the ordinance changing th~ assessment against the Fisk property, h~ <br />would file papers to drop the law suit brought~ against the City by the Fisk estate" <br /> <br />Stanley Darling, attorney for the DeNeffe property, asked if there would be reassessment of prop- <br />erties in the proposed-district at this time, and was told any adjustment in assessments would be <br />made after construction of the facility. Mr. Darling also asked if other properties' also would be <br />exempted if property owners brought in affidavits with regard to use of their properties for public <br />parking when present leases expire. The City Attorney replied the assessment is made on present <br />use only. <br /> <br />Mayor Cone entered tha meeting and assumed the Chair. <br /> <br />2 <br /> <br />2. Curb Sidewalk.-Sweet Gum Park - Wyatt S. Rogers requested permission to locata side- <br />walks at the curb in Sweet Gum Park south of' Harlow Road. The Public Works Department <br />recommended denial since there are no topographic or right-of-way problems involved.' <br />Mr. McNutt moved seconded by Mr. Anderson to deny the request. Motion carried. <br /> <br />I <br /> <br />Mrs. Lauris moved seconded by Mr. Lassen to approve Item 2 of the Committee" report. - Motion carried. <br /> <br />3 <br /> <br />3. Appointments. Human Rights Commission - Mayor Cone announced the reappointment of <br />Erwin Juilfs, 2565 VanNess Street, and Jens Horstrup, 2245 Grant Street,as members of <br />the Human Rights Commission for the term ending January 1, 1970. Dr. Purdy moved <br />seconded by Mr. McNutt to affirm the reappointments. Motion carried. <br /> <br />e <br /> <br />Mrs. Lauris moved seconded by Mrs. Hayward to approve Item 3 of the Committee report. Motion carried. <br /> <br />4 <br /> <br />4. portland Meadows. Eugene Day - A letter was read from Harold Younkers,' director of <br />public, relations .for Portland Meadows, Inc., extending an invitation for March 25, <br />1967. That day h~ssbeen set aside fot the running of the Eugene Handicap. <br /> <br />Mrs. Lauris moved seconded- by, Mr. Lassen that Item 4 of the Committee report be received and filed. <br />Motion carried. <br /> <br />5 <br /> <br />5. Willakenzie Land Us~ Plan ~ Copies of the land us~ plan for' the Willakenzie area, <br />prepared by the Central Lane Planning Council, were distributed to Council members. <br />A public hearing onthe plan is scheduled for March 9, 1967,.'7:-30 p~m., in the <br />Council Chamber, before both County and City Planning Commissions. Considerable <br />discussion.foll6wed with re~ard to rezoning requests recently submitted which would <br />allow location of automobile sales co~pan~es in the Willakenzie area. One of the <br />requests (motorama at.Coburg and Belt Line Roads) has been'tabled by the County <br />Planning Commission pending study and adoption of the land use plan. . Councilman <br />Purdy commented that a policy should be set-requiring properties contiguous to the <br />City to annex to the City if they petition a zone change in the County. Mr.Anderson <br />moved seconded by Mr. McNutt to recommend to the Lane County Commissioners that they <br />table any request for zone change in the Willakenzie area, pending completion and <br />adoption of the Willakenzie Land Use Plan, and that the City Planning Commission be <br />instructed to render whatever assistance they can in this regard to the County Plan- <br />,ni'1).g Commission.
