<br />e <br /> <br />3'O~ <br /> <br />5/8/67 <br /> <br />I <br /> <br />e <br /> <br />I <br /> <br />I <br /> <br />e <br /> <br />I <br /> <br />e <br /> <br />Attorney said his investigation revealed that (a) the Planning staff did not require <br />posting of bond for streets as required in the subdivision ordinance; (b) payment of <br />outstanding taxes on the property prior to the minor subdivision was not required; and <br />(c) the requirement of granting the subdivision only if there is an existing street or <br />road was not followed. He said with regard to the third point' that streets were dedicated' <br />simultaneously with approval of the subdivision. It is his opinion that the subdivision <br />could be revoked but is not required; that Mr. Baitis could attack the legality of the <br />Commission's action in court; and that the Planning Commission has the entire authority <br />in the matter of revoki"ng or not revoking the subdivis ion, the Council having no juris- <br />diction in the matter. The Council was informed that court action is now pending be- <br />tween the property owner and the contract buyers. Mr. Baitis again called the Council's <br />attention to the legal points he raised as a result of being told previously that the <br />Council could take action only if error was found in issuance of the house moving permit. <br />No action was taken. <br /> <br />1 <br /> <br />7. Ordinances. Weed Control and Auto Immobilization - Copies were distributed for Council <br />study and consideration at a later date. <br /> <br />2 <br /> <br />8. Motion carried. <br /> <br />Items on May 4, 1967 Committee agenda not considered at that time: <br /> <br />3 <br /> <br />1. Washburne Park - The Parks Department reported that the 1963 appraised value of five <br />lots immediately north of Washburne Park was $63,250. At that time, the Council de- <br />cided not to purchase them. Some Council members said they felt, because of the <br />changing character of the neighborhood, there would be more use for a playground- <br />type park. The Parks Department plans to eventually close a street running through <br />the park, adding about 3/4-acre for use, but to maintain the character of the park <br />essentially as it is now. <br /> <br />Mr. Lassen moved seconded by Dr. Purdy that the item be received and filed. Motion carried. <br /> <br />4 <br /> <br />2. Park Property Purchase. Bethel-Danebo. Petersen - The Parks Department reported that <br />Paul, Richard, and George Petersen are willing to sell to the City about 12 acres <br />lying north of Royal Avenue and east of Ellsworth Street for $40,989. Payment is to <br />be made over a 3-year period with the first payment being due after July 1, 1967, <br />and 4% interest charged on the balance. The Petersens stipulate also that the park <br />is to be named "Philip Petersen Park" in memory of the son of George and Marjorie <br />Petersen. <br /> <br />Dr. Purdy moved seconded by Mr. Lassen to proceed with the purchase of the property. Rollcall vote. <br />All councilmen present voting aye, motion carried. <br /> <br />5 <br /> <br />3. Ordinance. Weed Control - Amendment to the weed control regulations was presented <br />which would delete the second mowing date of the year now in effect, and instead <br />require mowing by June 1 and then keeping the growth at a height of no more than <br />10 inches for the balance of the summer. The amendment also adds a $2.50 penalty <br />for late payment of a mowing charge. <br /> <br />Dr. Purdy moved seconded by Mr. Anderson to approve the amendment. Motion carried. (See Ordinance <br />14815.) <br /> <br />6 <br /> <br />4. Contract Extensions - A list of projects was presented which because of bad weather <br />or conflicts with other construction have exceeded the time limit set for completion. <br />Liquidated damages of $350 were assessed on one project, contracted to Boles Builders, <br />The Public Works Department recommended time extmsion on each of the projects and, <br />instead of collecting liquidated damages, that Boles Builders be removed from the <br />eligible list of bidders for one year. <br /> <br />Dr. Purdy moved seconded by Mr. McNutt to approve the recommendation. Motion carried. <br /> <br />7 <br /> <br />5. Parking Prohibition. Highway 99N - The Council previously considered parking prohibi- <br />tion on Highway 99N from Roosevelt Boulevard to the north City limits. However, com- <br />plaints from motel owners in the vicinity resulted in the recommendation that parking <br />be prohibited only between the hours of 6:00 a.m. and 9:00 p.m. <br /> <br />Dr. Purdy moved seconded by Mr. Anderson to approve the recommendation. Motion carried. <br /> <br />8 <br /> <br />6. Curb Sidewalk. south side 28th. Taylor to Almaden - The Public Works Department, as <br />the result of a request from Floyd Hodges, 2810 Taylor Street, recommended location <br />of the sidewalk at the curb on the south side of 28th Avenue between Taylor and <br />Almaden to maintain uniformity in the area. <br /> <br />Dr. Purdy moved seconded by Mr. Anderson to approve the recommendation.
