A maximum height of 40 feet was also <br />recommended for the Judkins Point area lying generally between the Willamette <br />River and lines south of 13th and 15th on the south and between Interstate 5 and <br />a line between Onyx and Beech if extended north of Franklin Boulevard. The Plan~ing <br />Director said the University of Oregon was contacted, and these recommendations will <br />no~ hamper its immediate development plans. Mrs. Lauris moved seconded by Mrs.Hayward <br />to amend the Zoning Code as recommended as an interim plan until the new zoning <br />ordinance is adopted. Motion carried. <br /> <br />Mr. Lassen moved seconded by Mr. McDonald to approve Item 2a of the Committee report. Motion carried. <br /> <br />Mr. Lassen moved seconded by Mr. McDonald to approve Item 3a of the Committee report. <br /> <br />Betty Niven, Planning Commission member, explained the height restrictions were recommended as an <br />'~ interim plan until the new development plan is adopted, since the new zoning ordinance makes no pro- <br />~ vision for height restrictions other than those now in effect. She suggested creation of a conserva- <br />tion committee for the study of landmarks as vista points, but said Skinners Butte and Judkins Point, <br />because of their proximity to congested areas, should be protected by interim restrictions and asked <br />that each be considered separately. <br /> <br />Fred Braatz, 795 West 36th, representing several owners of property along Franklin Boulevard, asked <br />I that a committee be appointed to study the particular problem of height restrictions 'in the area of <br />Judkins Point. He agreed with the Planning Director's suggestion that any plans for buildings over <br />40 feet in height be considered on an individual basis. <br /> <br />Jack Foster, representing Coca Cola Bottling Company on Frankl~n Bo~levard, said height restrictions <br />on structures near Judkins Point would affect property values. Joe Romania, representing Lew Williams <br />Chevrolet, said it would be logical to have restrictions on signs but not on buildings. <br /> <br />Further discussion brought out that the last zoning review of the area proposed for height restrictions <br />was about 1961, and that appeal, should the restrictions be imposed, would be handled by the Planning <br />Commission, not the Board of Appeals. <br /> <br />Mrs. Hayward suggested a 65-foot height restriction with individual review of anything between 40 <br />and 65 feet before issuance of a building permit. Mr. Wingard recommended no restrictions, but a <br />review of anything higher than 40 feet. <br /> <br />Mrs. Niven suggested the restrictions on the Judkins Point area be referred back to the Planning Com- <br />mission for further co nsideration. <br /> <br />Mr. Lassen withdrew his motion to approve the committee report. <br /> <br />Mr. Wingard moved seconded by Mr. Lassen to refer the Judkins Point matter back to the Planning Com- <br />mission. Motion carried. <br /> <br />'I In discussion of the height restrictions in the Skinners Butte area, Cliff Shirley of Universal De- <br />velopers owning property at the foot of Skinners Butte, asked that this also be referred back to the <br />Planning Commission. He said he felt such restrictions would devaluate the property. The City <br />Manager suggested incorporation of a conditional use procedure for review of specific building plans <br />in this area. Mrs. Niven said because of the difference in required criteria between the Skinners <br />Butte area and the Judkins Point area, the 40-foot limit should be adhered to aIDund Skinners Butte. <br /> <br />Mrs. Hayward moved seconded by Mr. McDonald to adopt the Planning Commission recommendation for <br />~ height restrictions in the designated area around Skinners Butte. Motion carried, Mr. McNutt voting no. <br /> <br />There was some further discussion in which it was generally agreed that adoption of the height re- <br />strictions is an interim plan until adoption of a new development plan for the metropolitan area. <br />Also, that height restrictions on signs are included in the new sign ordinance now being considered. <br /> <br />1 b. Conditional Use, City-owned Property, east side Washington south of Willamette <br />River, Child Care, Inc. - The Planning Commission recommended approval of use of <br />the Raup house at 169 North Washington for operation of a day nursery by Child <br />Care, Inc. The property was acquired by the City for future park purposes. The <br />recommendation "is subject to (1) maintenance of site in a residential manner; <br />(2) signs limited to one, 12 square feet; (3) maintenance of properties along the <br />western and southern portions of the property as site screening; (4) locating <br />and fencing the play area on the northwestern portion of the lot; (5) provision <br />of adequate off-street parking; and (6) review of the operation may be required <br />within two years. The Parks Department recommended rent-free use of the property <br />1- so that the City may apply for exemption from property taxes. Mm. Lauris moved <br />seconded by Mrs. Hayward to approve the Planning Commission and Parks Department <br />recommendations. Motion carried. <br /> <br />Mr. Lassen moved seconded by Mr. McDonald to approve Item 3b of the Committee report. MotiDn carried. <br /> <br />2 c. Easement Vacation, Cresta de Ruta and Capita Drive, Robert Mention -: ,The Planning <br />Commission recommended approval of Robert Mention's request for vacation ,of a <br />seven-foot utility easement on the east side of Lot 5, Block 1, Cresta de Ruta <br />4IJ Addition. A letter was read from James Bell, o~ner of property abutting Mr.Mention's <br />property on the north. Mr. Bell asked denial of the vacation because of the possi- <br />bility that this easement could better serve his property for a sewer lateral than ! <br />Ii 6/26/67 - 9 I\~ <br />
