<br /> 3'7 "? <br />. <br /> 7/10/67 <br />I the City, and asked that they retain some control over public and City access to the <br /> dedicated land to prevent any interference with Valley River's parking area. He said <br /> the dedication is for the purpose of maintaining the Green Belt concept along the River <br /> and asked that the City landscape property in its ownership on the south bank directly <br /> across from the strip to be dedicated. He also said negotiations are in progress with <br /> owners of property on both sides of the Valley River land to provide similar treatment <br /> for the riverbank. Mrs. Lauris moved seconded by Mr. Lassen to accept the dedication. <br /> Motion carried. It was understood the staff would bring back a recommendation with re- <br /> gard to landscaping the City property on the south bank of. the River. <br /> Mr. Anderson moved seconded by Mrs. Lauris to approve Item 2 of the committee report. Rollcall vote. <br /> All councilmen preseht voting aye, motion carried. <br /> 1 3. Easement Vacation, Cresta de Ruta, Mention - Council members toured the site of the <br /> requested easement vacation at 2695 Cresta de Ruta. Robert C. Mention requested the <br /> vacation to permit construction of a driveway retaining wall. Objections were pre- <br />e sented by James Bell, owner of property to the east facing on Capital Drive, on the <br /> basis that the easement would be needed for sewer line to his property. The Public <br /> Works Department suggested a co-operative agreement between the two property owners <br /> which would allow construction of the sewer line to the adjacent property at the <br /> same time the retaining wall is constructed. Mr. Mention had no objection to an <br /> agreement, but Mr. Bell said he did not want to invest further in his property at <br /> this time. Further discussion revealed that the proposed retaining wall would en- <br />I creach three feet into the easement for a distance of about 20 feet. MrS.Lauris <br /> moved seconded by Mr. Anderson to retain the public easement but to permit construc- <br /> tion of the retaining wall in the easement with the understanding that Mr. Mention <br /> would lay a sewer line through the critical area at the same time the wall is con- <br /> structed, and with the further understanding that Mr. Mention would be reimbursed for <br /> the cost of the dry line from the connection charge for the adjacent property equivalent <br /> to an assessment if the sewer -is put into use to serve the Bell property. Motion carried. <br /> Mr. Anderson moved seconded by Mrs. Lauris to approve Item 3 of the Committee report. Motion carried. <br /> 2 4. Right-of-Way, 18th Avenue, Mayers-Williams - Permission was requested to purchase <br /> right-of-way on the north side of 18th immediately east of Oak Patch Road from <br /> Raymond and Lenetta Mayers and Clarence and Irma Williams for $1500, the cppraised <br /> price. The purchase includes a slope easement. Mr. McNutt move d seconded by Mr. <br /> McDonald to purchase the land and slope easement. Motion carried. <br /> Mr. Anderson moved seconded by Mrs. Lauris to approve Item 4.of the Committee report. Rollcall vote. <br /> All councilmen present voting aye, motion carried. <br /> 3 5. Condemnation, Storm Drainage Easement, Elder - The Public Works Department requested <br /> authorization to condemn for drainage ditch easement across property of W. Howard and <br /> Rose Elder north of 18th Avenue between Oak Patch Road and Wilson Court. The drainage <br /> is needed in connection with the 18th Avenue paving. Negotiations have fai led to <br /> bring an agreement on price. Mr. McNutt moved seconded by Mr. Anderson to authorize <br />I condemnat ion. Motion carried. <br /> 4 6. Sanitary Sewer, Alley between Hilyard and Alder, 260 feet north of 25th - Petitioned <br /> by the owner of 9.4% of property to be assessed. The Public Works Department recom- <br /> mended construction of the sewer to provide complete coverage of the area since it <br /> will serve six properties in the middle of the block bounded by Hilyard and Alder, <br /> 24th and 25th, which have not been assessed for sanitary sewers. The cost is estimated <br /> at 6~ per square foot. Mrs. Lauris moved seconded by Mr. Anderson to proceed. Motion <br /> carried. <br />e 5 7. Package Store Class A, Prall's Market , 295 West 17th - Clifford W. and Anna Mae Prall <br /> requested endorsement of a license for this location, formerly Mayfield's Market, <br /> near Wilson Junior High. The Police Department recommended approval since the school <br /> will no longer be in use. Mr. Anderson moved seconded by Mr. McNutt to recommend <br /> approval of the license. Motion carried. <br /> Mr. Anderson moved seconded by Mrs. Lauris to approve Items 5, 6, and 7 of the Committee report. <br /> Motion carried. <br /> 6 8. Metro Civic Club City/County Jail Report - Copies of this report were distributed to <br /> Council members, along with copies'of an article from the May 1967 Reader's Digest - <br /> "Can Local Government Be Saved?" <br /> 7 9. Resignation, Assistant City Attorney - The City Attorney announced the resignation of <br />I Pierre VanRysse1berghe, assistant city attorney, and said he would now be taking appli- <br /> cations for a replacement." <br /> Mr. Anderson moved seconded by Mrs. Lauris that Items 8 and 9 of the Committee report be received and <br /> filed. Motion carried. <br /> The City Manager said the Metro Club's report on the City/County jail, as well as the Club's report <br /> on development of Skinners Butte, would be scheduled for consideration at committee meetings in the <br /> near future. <br />- <br /> II 7/10/67 - 9 \\~ <br />
