William J. Dwyer, 5005 Nectar Way, said he did not favor disguising legislation <br />aimed at "topless" dancers by including it in a disorderly conduct law. <br /> <br />Mr. McDonald moved seconded by Mr. Lassen to' include a section in the disorderly conduct <br />ordinance to regulate type of attire to be worn by female entertainers~, Motion carried, <br />Mrs. Lauris, Mr.' Anderson, and Mrs. Hay~ard voting no. <br /> <br />The City Attorney said he was working on suggestions for"a separate ordinance which would be brought <br />to a committee-of-the-who1e meeting for consideration. <br /> <br />Councilman Anderson read Section 6.14 of the Eugene City Code and said he felt this section of the tit <br />present Code would give enforcement authority necessary. <br /> <br />Mr. John Kirk stated that' the businessman is usually responsible for his employes' actions and said <br />that, in this i!J-stance, any legislation should inake..the employer responsible for violation, not the <br />performer. . <br /> <br />Mr. Anderson moved seconded by Dr. Purdy to'table the item until the City Attorney's recommendation is 1 <br />brought to committee. Motion carried. <br /> <br />1 6. Apartment. 563 Jefferson. Moved to 2nd and High - The Building Department withheld'a <br />permit pending Council approval to move this building to 212 High Street. Council <br />members looked at the apartment at 563 Jefferson Street and at the site to which it is ' <br />proposed to be moved~ William A.' Davenport explained the project and'said he is willing <br />to post a'$5000 bond to a~su~e completion of the apartment's remodeling after it is <br />moved. A~' i~ediate decision was needed since the house is one,on'which the State High- <br />way Department will'be accepting b~ds on August 22, and the"developer does not~ant to <br />enter a bid without knowing if the'City'wi1l permit moving the'structure. Mrs. Lauris <br />moved- seconded ~y Mr~ Wingard to approve moving the building as requested; providing a <br />$5000 per~0rmance bond is p~sted and plans and specifications which were presente~ fcr <br />remodeling are submitted for revie~. Motion carried. <br /> <br />The City Manager said that Mr~ Davenport_was the successful bidder on the building- at 563 Jefferson, <br />so would be moving the'bui1ding to 2i2High'Street. Councilman'Wingard as~ed that the record show <br />that the plans and specifications to be submitted for review and bonding are to be those which were <br />presented to the Council. <br /> <br />Dr. Purdy moved -seconded by Mr. Anderson to approve Item 6 of the Committee report. Motion carried. <br /> <br />2 7. Council Meeting. August 28. 1967 -' It was announced that because several' councilmen 0 1 <br />will be out of town'on the day of the'regularly scheduled Council meeting on August 28 . <br />themeeting will be postponed to August 29." . . f3tJ <br /> <br />Dr. Purdy moved seconded'by Mr. Anderson that Item 7 of the Committee report be received arid filed. <br />Motion carried! <br /> <br /> <br />Committee meeti~g held August 24, 1967: <br /> <br />"Present: Mayor Con,e; Councilmen Purdy, Lauris, ,Anderson, Lassen, McDonald, and Wingard;' e <br />, City Manager and staff; and others. <br /> <br />3 1. Public Works Bids. Opened August 22. 1967 - A tabulation was presented of bids sub- <br />mitted for construction of a sidewalk on 27th and sanitary sewer in Bethe1-Danebo <br />improvement district BD-67-l6. Mr. Lassen.moved seconded by Dr. Purdy to award con- <br />tracts to the low bidder on each project: Motion carried. <br /> <br />Dr.' Purdy moved seconded by Mr~'Ande!son that Item 1 of the Committee report be received and filed. <br />Motion carried. Sewer Assessment Policy:-- The Public Works Director pres,ented a report describing the <br />computer p'rogram which will be: used the 'first time in September- to compute the Bethe1- <br />Danebo assessments. It was also reported that the' City is now installing all 'stub <br />lines to the property lines, which is considered a more equitable policy than the 1- <br />method previously used, and the mthoed now being used for calculation of individual <br />assessments was explained. Also discussed was' the: question of'whether the City should <br />participate in the cost of over-depth sewer lines in the same way it does in over-size <br />construction. It wa's report:ed that difficult terrain and soil conditions in p:art of <br />the Bethel-Danebo area resulted in excessive cost to the property owners. It was recom- <br />mended that sewer systems in which more than 28% is deeper than lO-foot average and in <br />which the assessment r,ate wo'uld: be more than 7(;. should be a.ssessed' a maximum rate of 7<:,: <br />'per s-quare foot(trunk sewer cost of ~(;. per squar-e foot not included).
